Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROHIBITION ON SECURITY ASSISTANCE. 3 (a) IN GENERAL.—Beginning on the date of the en- 4 actment of this Act, the Secretary of Defense may not— 5 (1) provide any United States assistance, in- 6 cluding security assistance, intelligence, training, 7 VerDate Sep 11 2014 23:12 Jan 30, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H643.IH H643 pamtmann on DSKBFK8HB2PROD with BILLS 2 •HR 643 IH equipment, or services relating to maintenance, test- 1 ing, or technical data, to— 2 (A) the Government of Saudi Arabia, in- 3 cluding the Ministries of Defense, Interior, and 4 Intelligence; or 5 (B) any agent or instrumentality of such 6 Government; or 7 (2) engage in any defense cooperation with such 8 Government, Ministries, agents, or instrumentalities. 9 (b) EXCEPTION FOR THE PROTECTION OF UNITED 10 STATES PERSONNEL AND CITIZENS.—The prohibition 11 under subsection (a) shall not apply with respect to activi- 12 ties of the Department of Defense relating to the protec- 13 tion of United States diplomatic and consular posts or per- 14 sonnel or to the evacuation of United States citizens. 15 SEC. 2. PROHIBITION ON ARMS SALES. 16 Beginning on the date of the enactment of this Act, 17 the President may not sell, transfer, deliver, license for 18 export, authorize the performance of any service relating 19 to, or otherwise make available any defense article, defense 20 service, or design and construction service, as such terms 21 are defined for purposes of the Arms Export Control Act 22 (22 U.S.C. 2751 et seq.), to the Government of Saudi Ara- 23 bia or to any agents or instrumentalities of such Govern- 24 ment. 25 VerDate Sep 11 2014 23:12 Jan 30, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H643.IH H643 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 643 IH SEC. 3. CASE-BY-CASE WAIVER OF PROHIBITIONS ON SECU- 1 RITY ASSISTANCE AND ARMS SALES. 2 (a) JOINT RESOLUTION OF APPROVAL TO WAIVE.— 3 The prohibitions in sections 1 and 2 may be waived on 4 a case-by-case basis if— 5 (1) the President submits to the appropriate 6 congressional committees a request to conduct a spe- 7 cific activity otherwise prohibited by such sections; 8 and 9 (2) there is enacted a joint resolution approving 10 the waiver of such prohibition with respect to such 11 specific activity. 12 (b) REPORT ACCOMPANYING REQUEST.—Each re- 13 quest submitted pursuant to subsection (a)(1) shall also 14 include a report describing— 15 (1) how the requested activity would advance 16 the national security and defense interests of the 17 United States; 18 (2) the status of the United States investigation 19 into each person who— 20 (A) authorized, ordered, carried out, or 21 had knowledge of the murder of journalist and 22 United States permanent resident Jamal 23 Khashoggi; or 24 VerDate Sep 11 2014 23:12 Jan 30, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H643.IH H643 pamtmann on DSKBFK8HB2PROD with BILLS 4 •HR 643 IH (B) participated in attempts to cover up 1 information regarding the murder of Mr. 2 Khashoggi; 3 (3) the extent to which each person described 4 pursuant to paragraph (2) has been prosecuted or 5 otherwise held accountable for such conduct; and 6 (4) the status of the protection of human 7 rights, including the freedom of the press, in Saudi 8 Arabia. 9 (c) APPROPRIATE CONGRESSIONAL COMMITTEES DE- 10 FINED.—In this section, the term ‘‘appropriate congres- 11 sional committees’’ means— 12 (1) the Committee on Armed Services and the 13 Committee on Foreign Affairs of the House of Rep- 14 resentatives; and 15 (2) the Committee on Armed Services and the 16 Committee on Foreign Relations of the Senate. 17 Æ VerDate Sep 11 2014 23:12 Jan 30, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H643.IH H643 pamtmann on DSKBFK8HB2PROD with BILLS
