A BILL
To make revenue from certain duties imposed on goods im-
ported from the People’s Republic of China available
for border security, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Border, Law Enforce-
4
ment, Operational Control, and Sovereignty Act of 2019’’.
5
SEC. 2. ADDITIONAL FUNDING FOR BORDER SECURITY.

(a) TRANSFER OF CERTAIN REVENUE FROM DUTIES

TO SECRETARY OF HOMELAND SECURITY.—

(1) IN GENERAL.—The Secretary of the Treas-
1
ury shall transfer to the Secretary of Homeland Se-
2
curity from the general fund of the Treasury
3
amounts determined by the Secretary of the Treas-
4
ury to be equivalent to 50 percent of the amounts
5
received into the general fund that are attributable
6
to duties imposed under section 301 of the Trade
7
Act of 1974 (19 U.S.C. 2411) with respect to goods
8
imported from the People’s Republic of China on or
9
after July 6, 2018.

(2) ADMINISTRATION OF TRANSFERS.—

(A) IN GENERAL.—The amounts required
12
to be transferred under paragraph (1) shall be
13
transferred not less frequently than quarterly
14
from the general fund of the Treasury to the
15
Secretary of Homeland Security on the basis of
16
estimates made by the Secretary of the Treas-
17
ury of the amounts described in paragraph (1)
18
that are received into the Treasury.

(B) ADJUSTMENTS.—Proper adjustments
20
shall be made in the amounts described in para-
21
graph (1) subsequently transferred under that
22
paragraph to the extent prior estimates were in
23
excess of, or less than, the amounts required to
24
be transferred.

(b) USE
OF FUNDS
FOR BORDER SECURITY.—

Amounts transferred under subsection (a) shall be avail-
2
able, without further appropriation, to the Secretary of
3
Homeland Security to install physical barriers and roads
4
described in section 102 of the Illegal Immigration Reform
5
and Immigrant Responsibility Act of 1996 (division C of
6
Public Law 104–208; 8 U.S.C. 1103 note), including for
7
the construction of fencing and road improvements de-
8
scribed in subsection (b) of that section.
