national intersection and interchange safety construction
program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘National Intersection
4
and Interchange Safety Construction Program Act of
5
2019’’.

SEC. 2. NATIONAL INTERSECTION AND INTERCHANGE
7
SAFETY CONSTRUCTION PROGRAM.

(a) ESTABLISHMENT.—Not later than 180 days after
9
the date of enactment of this Act, the Secretary of Trans-

portation shall establish a national intersection and inter-
1
change safety construction program (in this section re-
2
ferred to as the ‘‘Program’’) to assist safety improvements
3
for high-risk intersections and interchanges.
4
(b) GRANT AUTHORITY.—
5
(1) IN
GENERAL.—In carrying out the Pro-
6
gram, the Secretary may make a grant to a covered
7
entity in accordance with this section.
8
(2) COMPETITIVE BASIS.—The Secretary shall
9
award grants under the Program on a competitive
10
basis.
11
(c) PROJECT REQUIREMENTS.—The Secretary may
12
only make a grant under the Program to assist a project
13
that—
14
(1) is eligible for funding under title 23, United
15
States Code; and
16
(2) will improve the safety of an intersection or
17
interchange that is—
18
(A) on the National Highway System;
19
(B) used by an average of 50,000 vehicles
20
a day; and
21
(C) in immediate need of improvement
22
with respect to safety.

(d) APPLICATIONS.—To be eligible for a grant under
24
the Program, a covered entity shall submit to the Sec-

retary an application in such form, at such time, and con-

taining such information as the Secretary determines is
2
appropriate.

(e) LIMITATION.—The aggregate amount provided to
4
a covered entity in a fiscal year through grants under the
5
Program may not exceed 5 percent of the amount made
6
available for all grants under the Program in that fiscal
7
year.
8
(f) CONGRESSIONAL REVIEW.—At least 90 days be-
9
fore establishing the Program under subsection (a), the
10
Secretary shall submit to Congress a report detailing the
11
selection process the Secretary shall use in making grants
12
under the Program.
13
(g) COVERED ENTITY DEFINED.—In this section, the
14
term ‘‘covered entity’’ means each of the following:
15
(1) A State government entity.
16
(2) A local government entity.
17
(3) A territory of the United States.
18
(4) A tribal government.
19
(5) A metropolitan planning organization.
20
(6) Any entity composed of 2 or more entities
21
described in paragraphs (1) through (5).

(h) AUTHORIZATION OF APPROPRIATIONS.—

(1) IN GENERAL.—There is authorized to be
24
appropriated out of the Highway Trust Fund (other

(2) APPLICABILITY
OF
TITLE
23,
UNITED

STATES
CODE.—Funds authorized to be appro-
4
priated by paragraph (1) shall—
5
(A) be available for obligation in the same
6
manner as if those funds were apportioned
7
under chapter 1 of title 23, United States Code,
8
except that the Federal share of the cost of a
9
project or activity carried out using those funds
10
shall be 80 percent; and
11
(B) remain available until expended and
12
not be transferable.
