HOURS OF SERVICE REGULATIONS FOR TRANSPOR- 1 TATION OF CERTAIN ANIMALS. 2 (a) IN GENERAL.—The Secretary of Transportation 3 shall amend part 395 of title 49, Code of Federal Regula- 4 tions, to ensure that, in the case of a driver transporting 5 a covered animal within a 300 air-mile radius from the 6 point at which the on-duty time of the driver begins with 7 respect to the trip— 8 (1) the on-duty time of the driver shall exclude 9 all time spent— 10 (A) at a plant, terminal, facility, or other 11 property of a motor carrier or shipper or on any 12 public property during which the driver is wait- 13 ing to be dispatched; 14 (B) loading or unloading a commercial 15 motor vehicle; 16 (C) supervising or assisting in the loading 17 or unloading of a commercial motor vehicle; 18 (D) attending to a commercial motor vehi- 19 cle while the vehicle is being loaded or un- 20 loaded; 21 (E) remaining in readiness to operate a 22 commercial motor vehicle; and 23 (F) giving or receiving receipts for ship- 24 ments loaded or unloaded; 25 VerDate Sep 11 2014 21:02 Jan 25, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H487.IH H487 pbinns on DSK79D2C42PROD with BILLS 3 •HR 487 IH (2) except as provided in paragraph (5), the 1 driving time under section 395.3(a)(3)(i) of that title 2 is modified to a maximum of not less than 15, and 3 not more than 18, hours within a 24-hour period; 4 (3) the driver may take one or more rest peri- 5 ods during the trip, which shall not be included in 6 the calculation of the driving time; 7 (4) after completion of the trip, the driver shall 8 be required to take a rest break for a period that 9 is 5 hours less than the maximum driving time 10 under paragraph (2); 11 (5) if the driver is within 150 air-miles of the 12 point of delivery, the driver may continue for not 13 more than 2 additional hours, which shall not be in- 14 cluded in the calculation of the driving time; and 15 (6) the 10-hour rest period under section 16 395.3(a)(1) of that title shall not apply. 17 (b) COVERED ANIMAL.—In this Act, the term ‘‘cov- 18 ered animal’’ means a live animal that is one of the fol- 19 lowing: 20 (1) Livestock (as defined in section 602 of the 21 Agricultural Act of 1949 (7 U.S.C. 1471)). 22 (2) Honey bees. 23 (3) Insects. 24 (4) Fish. 25 VerDate Sep 11 2014 21:02 Jan 25, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H487.IH H487 pbinns on DSK79D2C42PROD with BILLS 4 •HR 487 IH (5) Crawfish. 1 Æ VerDate Sep 11 2014 21:02 Jan 25, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H487.IH H487 pbinns on DSK79D2C42PROD with BILLS
