Mr. LYNCH (for himself, Mr. CHABOT, Mr. KEATING, Ms. CLARK of Massa-
chusetts, and Mr. MCGOVERN) introduced the following bill; which was
referred to the Committee on Natural Resources
A BILL
To establish the Adams Memorial Commission to carry out
the provisions of Public Law 107–62, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. ADAMS MEMORIAL COMMISSION.
3
(a) COMMISSION.—There is established a commission
4
to be known as the ‘‘Adams Memorial Commission’’ (re-
5
ferred to in this section as the ‘‘Commission’’) for the pur-
6
pose of establishing a permanent memorial to honor John
7
Adams and his legacy as authorized by Public Law 107–
8
62, located in the city of Washington, District of Colum-
9
bia, including sites authorized by Public Law 107–315.

(b) MEMBERSHIP.—The Commission shall be com-

posed of—
2
(1) four persons appointed by the President,
3
not more than two of whom may be members of the
4
same political party;
5
(2) four Members of the Senate appointed by
6
the President pro tempore of the Senate in consulta-
7
tion with the majority leader and minority leader of
8
the Senate, of which not more than two appointees
9
may be members of the same political party; and
10
(3) four Members of the House of Representa-
11
tives appointed by the Speaker of the House of Rep-
12
resentatives in consultation with the majority leader
13
and minority leader of the House of Representatives,
14
of which not more than two appointees may be mem-
15
bers of the same political party.

(c) CHAIR AND VICE CHAIR.—The members of the
17
Commission shall select a Chair and Vice Chair of the
18
Commission. The Chair and Vice Chair shall not be mem-
19
bers of the same political party.

(d) VACANCIES.—Any vacancy in the Commission
21
shall not affect its powers if a quorum is present, but shall
22
be filled in the same manner as the original appointment.

(1) INITIAL MEETING.—Not later than 45 days
1
after the date on which a majority of the members
2
of the Commission have been appointed, the Com-
3
mission shall hold its first meeting.
4
(2) SUBSEQUENT MEETINGS.—The Commission
5
shall meet at the call of the Chair.
6
(f) QUORUM.—A majority of the members of the
7
Commission shall constitute a quorum but a lesser number
8
of members may hold hearings.
9
(g) NO COMPENSATION.—A member of the Commis-
10
sion shall serve without compensation, but may be reim-
11
bursed for expenses incurred in carrying out the duties
12
of the Commission.
13
(h) DUTIES.—The Commission shall consider and
14
formulate plans for a permanent memorial to honor John
15
Adams and his legacy, including the nature, location, de-
16
sign, and construction of the memorial.
17
(i) POWERS.—The Commission may—
18
(1) make such expenditures for services and
19
materials for the purpose of carrying out this section
20
as the Commission considers advisable from funds
21
appropriated or received as gifts for that purpose;
22
(2) accept gifts, including funds from the
23
Adams Memorial Foundation, to be used in carrying

out this section or to be used in connection with the

construction or other expenses of the memorial; and
2
(3) hold hearings, enter into contracts for per-
3
sonal services and otherwise, and do such other
4
things as are necessary to carry out this section.

(j) REPORTS.—The Commission shall—
6
(1) report the plans required by subsection (h),
7
together with recommendations, to the President
8
and the Congress at the earliest practicable date;
9
and
10
(2) in the interim, make annual reports on its
11
progress to the President and the Congress.
12
(k) APPLICABILITY OF OTHER LAWS.—The Federal
13
Advisory Committee Act (5 U.S.C. App.) shall not apply
14
to the Commission.
15
(l) TERMINATION.—The Commission shall terminate
16
7 years after the date of the enactment of this Act.

SEC. 2. AMENDMENT TO PUBLIC LAW 107–62.
18
Public Law 107–62 is amended by striking ‘‘Adams
19
Memorial Foundation’’ each place it occurs and inserting
20
‘‘Adams Memorial Commission’’.
