SHORT TITLE. 3 This Act may be cited as the ‘‘Defund Planned Par- 4 enthood Act of 2019’’. 5 SEC. 2. FINDINGS. 6 Congress finds the following: 7 (1) State and county health departments, com- 8 munity health centers, hospitals, physicians offices, 9 and other entities currently provide, and will con- 10 tinue to provide, health services to women. Such 11 health services include relevant diagnostic laboratory 12 and radiology services, well-child care, prenatal and 13 postpartum care, immunization, family planning 14 services (including contraception), cervical and 15 breast cancer screenings and referrals, and sexually 16 transmitted disease testing. 17 (2) Many such entities provide services to all 18 persons, regardless of the person’s ability to pay, 19 and provide services in medically underserved areas 20 and to medically underserved populations. 21 (3) All funds that are no longer available to 22 Planned Parenthood Federation of America, Inc. 23 and its affiliates and clinics pursuant to this Act will 24 VerDate Sep 11 2014 02:19 Jan 19, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H369.IH H369 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 369 IH continue to be made available to other eligible enti- 1 ties to provide women’s health care services. 2 (4) Funds authorized to be appropriated, and 3 appropriated, by section 4 are offset by the funding 4 limitation under section 3(a). 5 SEC. 3. MORATORIUM ON FEDERAL FUNDING TO PLANNED 6 PARENTHOOD FEDERATION OF AMERICA, 7 INC. 8 (a) IN GENERAL.—For the one-year period beginning 9 on the date of the enactment of this Act, subject to sub- 10 section (b), no funds authorized or appropriated by Fed- 11 eral law may be made available for any purpose to Planned 12 Parenthood Federation of America, Inc., or any affiliate 13 or clinic of Planned Parenthood Federation of America, 14 Inc., unless such entities certify that Planned Parenthood 15 Federation of America affiliates and clinics will not per- 16 form, and will not provide any funds to any other entity 17 that performs, an abortion during such period. 18 (b) EXCEPTION.—Subsection (a) shall not apply to 19 an abortion— 20 (1) if the pregnancy is the result of an act of 21 rape or incest; or 22 (2) in the case where a woman suffers from a 23 physical disorder, physical injury, or physical illness 24 that would, as certified by a physician, place the 25 VerDate Sep 11 2014 02:19 Jan 19, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H369.IH H369 pamtmann on DSKBFK8HB2PROD with BILLS 4 •HR 369 IH woman in danger of death unless an abortion is per- 1 formed, including a life-endangering physical condi- 2 tion caused by or arising from the pregnancy itself. 3 (c) REPAYMENT.—The Secretary of Health and 4 Human Services and the Secretary of Agriculture shall 5 seek repayment of any Federal assistance received by 6 Planned Parenthood Federation of America, Inc., or any 7 affiliate or clinic of Planned Parenthood Federation of 8 America, Inc., if it violates the terms of the certification 9 required by subsection (a) during the period specified in 10 subsection (a). 11 SEC. 4. FUNDING FOR COMMUNITY HEALTH CENTER PRO- 12 GRAM. 13 (a) IN GENERAL.—There is authorized to be appro- 14 priated, and appropriated, $235,000,000 for the commu- 15 nity health center program under section 330 of the Public 16 Health Service Act (42 U.S.C. 254b), in addition to any 17 other funds made available to such program, for the period 18 for which the funding limitation under section 3(a) ap- 19 plies. 20 (b) LIMITATION.—None of the funds authorized or 21 appropriated pursuant to subsection (a) may be expended 22 for an abortion other than as described in section 3(b). 23 VerDate Sep 11 2014 02:19 Jan 19, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H369.IH H369 pamtmann on DSKBFK8HB2PROD with BILLS 5 •HR 369 IH SEC. 5.
