A BILL
To direct the Attorney General, in enforcing the provisions
of the Controlled Substances Act relating to marijuana,
to focus on certain enforcement priorities.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Sensible Enforcement
4
of Cannabis Act of 2019’’.

SEC. 2. MARIJUANA ENFORCEMENT PRIORITIES.

(a) IN GENERAL.—In enforcing the provisions of the
7
Controlled Substances Act (21 U.S.C. 801 et seq.) relating
8
to the cultivation, manufacture, distribution, possession,

or use of marijuana, the Attorney General of the United
1
States shall not prosecute for any conduct that—
2
(1) concerns marijuana for medicinal or rec-
3
reational use; and
4
(2) is authorized by the laws of the State in-
5
volved.

(b) EXCEPTION.—Subsection (a) does not apply with
7
respect to prosecution for prevention of the following:
8
(1) Distribution of marijuana to minors.
9
(2) Revenue from the sale of marijuana from
10
going to criminal enterprises, gangs, and cartels.
11
(3) Diversion of marijuana from States where it
12
is legal under State law in some form to other
13
States.
14
(4) State-authorized marijuana activity from
15
being used as a cover or pretext for the trafficking
16
of other illegal drugs or other illegal activity.
17
(5) Violence and the use of firearms in the cul-
18
tivation and distribution of marijuana.
19
(6) Drugged driving and the exacerbation of
20
other adverse public health consequences associated
21
with marijuana use.
22
(7) The growing of marijuana on public lands
23
and the attendant public safety and environmental
