CONTINUING APPROPRIATIONS FOR CERTAIN EM- 1 PLOYEES OF THE DEPARTMENT OF HOME- 2 LAND SECURITY AND THE DEPARTMENT OF 3 JUSTICE. 4 (a) DEFINITION.—In this section, the term ‘‘covered 5 excepted employee’’ means an officer or employee— 6 (1) who is an officer or employee of an agency 7 that is subject to a lapse in appropriations during 8 fiscal year 2019; 9 (2) who is— 10 (A) an officer or employee of— 11 (i) U.S. Customs and Border Protec- 12 tion; 13 (ii) U.S. Immigration and Customs 14 Enforcement; 15 (iii) the Transportation Safety Admin- 16 istration; 17 (iv) the Coast Guard; 18 (v) the Federal Bureau of Investiga- 19 tion; or 20 (vi) the Central Intelligence Agency; 21 (B) an attorney employed by the Depart- 22 ment of Justice who prosecutes criminal of- 23 fenses; or 24 (C) an immigration judge employed by the 25 Department of Justice; and 26 VerDate Sep 11 2014 03:34 Jan 18, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S111.IS S111 kjohnson on DSK79L0C42 with BILLS 3 •S 111 IS (3) who is an excepted employee or an employee 1 performing emergency work, as such terms are de- 2 fined by the Office of Personnel Management. 3 (b) APPROPRIATION.—There are hereby appropriated 4 for fiscal year 2019, out of any money in the Treasury 5 not otherwise appropriated, to the head of each agency 6 that employs 1 or more covered excepted employees for 7 any period during which interim or full-year appropria- 8 tions for fiscal year 2019 are not in effect such sums as 9 are necessary to provide pay and allowances to each cov- 10 ered excepted employee of the agency. 11 (c) TERMINATION.—Appropriations made available 12 and authority granted under subsection (b) shall be avail- 13 able to the head of an agency until the earliest of— 14 (1) the enactment into law of a regular appro- 15 priations Act providing appropriations for the agen- 16 cy for fiscal year 2019; 17 (2) the enactment into law of a law providing 18 continuing or regular appropriations for the agency 19 for fiscal year 2019 that does not provide appropria- 20 tions for the purpose for which amounts are appro- 21 priated under subsection (b); or 22 (3) January 1, 2020. 23 (d) APPLICATION.—For a lapse in appropriations 24 that is in effect on the date of enactment of this Act, each 25 VerDate Sep 11 2014 03:34 Jan 18, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S111.IS S111 kjohnson on DSK79L0C42 with BILLS 4 •S 111 IS covered excepted employee shall be compensated for work 1 performed during the lapse in appropriations during the 2 period before such date of enactment at the standard rate 3 of compensation for the covered excepted employee at the 4 earliest date possible after such date of enactment. 5 Æ VerDate Sep 11 2014 03:34 Jan 18, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S111.IS S111 kjohnson on DSK79L0C42 with BILLS
