To direct the Secretary of Agriculture to transfer certain
National Forest System land to Custer County, South
Dakota.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Custer County Airport
4
Conveyance Act’’.
5
SEC. 2. DEFINITIONS.
6
In this Act:
7
(1) COUNTY.—The term ‘‘County’’ means Cus-
8
ter County, South Dakota.

(2) FEDERAL LAND.—The term ‘‘Federal land’’
1
means all right, title, and interest of the United
2
States in and to approximately 65.7 acres of Na-
3
tional Forest System land, as generally depicted on
4
the map.
5
(3) MAP.—The term ‘‘map’’ means the map en-
6
titled ‘‘Custer County Airport Conveyance’’ and
7
dated October 19, 2017.
8
(4) SECRETARY.—The term ‘‘Secretary’’ means
9
the Secretary of Agriculture, acting through the
10
Chief of the Forest Service.

SEC. 3. LAND CONVEYANCE.

(a) IN GENERAL.—Subject to the terms and condi-
13
tions described in subsection (b), if the County submits
14
to the Secretary an offer to acquire the Federal land for
15
the market value, as determined by the appraisal under
16
subsection (c), the Secretary shall convey the Federal land
17
to the County.

(b) TERMS
AND
CONDITIONS.—The conveyance
19
under subsection (a) shall be—
20
(1) subject to valid existing rights;
21
(2) made by quitclaim deed; and
22
(3) subject to any other terms and conditions
23
as the Secretary considers appropriate to protect the
24
interests of the United States.

(c) APPRAISAL.—

(1) IN GENERAL.—Not later than 60 days after
2
the date of enactment of this Act, the Secretary
3
shall complete an appraisal to determine the market
4
value of the Federal land.
5
(2) STANDARDS.—The appraisal under para-
6
graph (1) shall be conducted in accordance with—
7
(A) the Uniform Appraisal Standards for
8
Federal Land Acquisitions; and
9
(B) the Uniform Standards of Professional
10
Appraisal Practice.

(d) MAP.—
12
(1) AVAILABILITY OF MAP.—The map shall be
13
kept on file and available for public inspection in the
14
appropriate office of the Forest Service.
15
(2) CORRECTION OF ERRORS.—The Secretary
16
may correct any errors in the map.
17
(e) CONSIDERATION.—As consideration for the con-
18
veyance under subsection (a), the County shall pay to the
19
Secretary an amount equal to the market value of the Fed-
20
eral land, as determined by the appraisal under subsection
21
(c).

(f) SURVEY.—The exact acreage and legal description
23
of the Federal land to be conveyed under subsection (a)

shall be determined by a survey satisfactory to the Sec-
1
retary.

(g) COSTS OF CONVEYANCE.—As a condition on the
3
conveyance under subsection (a), the County shall pay to
4
the Secretary all costs associated with the conveyance, in-
5
cluding the cost of—
6
(1) the appraisal under subsection (c); and
7
(2) the survey under subsection (f).

(h) PROCEEDS FROM THE SALE OF LAND.—Any pro-
9
ceeds received by the Secretary from the conveyance under
10
subsection (a) shall be—
11
(1) deposited in the fund established under
12
Public Law 90–171 (commonly known as the ‘‘Sisk
13
Act’’) (16 U.S.C. 484a); and
14
(2) available to the Secretary until expended,
15
without further appropriation, for the acquisition of
16
inholdings in units of the National Forest System in
17
the State of South Dakota.
