Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PAYMENT. 3 The Secretary of the Treasury shall pay, out of any 4 money in the Treasury not otherwise appropriated, the 5 sum of $39,709.66 to Robert Feiss of Ojai, California, in 6 compensation for payments he was entitled to but did not 7 receive for years 2011 through 2013 under the Primary 8 Care Incentive Payment Program established under sec- 9 tion 1833(x) of the Social Security Act (42 U.S.C. 10 1395l(x)) and in consideration of the fact— 11 VerDate Sep 11 2014 03:05 Jan 10, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H423.IH H423 kjohnson on DSK79L0C42 with BILLS 2 •HR 423 IH (1) that Robert Feiss has served as an out- 1 spoken advocate for the health care needs of his pa- 2 tients through his work as a primary care physician; 3 and 4 (2) that, on May 30, 2018, the United States 5 Court of Federal Claims found that ‘‘It appears 6 that, through no fault of his own, plaintiff has lost 7 over $39,000 in government Medicare incentive pay- 8 ments that he was entitled to by providing Family 9 Practice services’’ and that ‘‘the evidence strongly 10 supports plaintiff’s argument that he was providing 11 Family Practice services and should have been clas- 12 sified as such, but a coding error denied plaintiff 13 this status for several years’’. 14 SEC. 2. SATISFACTION OF CLAIM. 15 The sum paid under section 1 shall be in full satisfac- 16 tion of any claims that Robert Feiss may have against 17 the United States arising on the basis of payments owed 18 for years 2011 through 2013 under the Primary Care In- 19 centive Payment Program described in section 1(1)(B). 20 SEC. 3.
