Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Mashpee Wampanoag 4 Tribe Reservation Reaffirmation Act’’. 5 SEC. 2. REAFFIRMATION OF INDIAN TRUST LAND. 6 (a) IN GENERAL.—The taking of land into trust by 7 the United States for the benefit of the Mashpee 8 Wampanoag Tribe of Massachusetts as described in the 9 final Notice of Reservation Proclamation (81 Fed. Reg. 10 VerDate Sep 11 2014 23:10 May 20, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H312.PCS H312 pbinns on DSK79D2C42PROD with BILLS 2 HR 312 PCS 948; January 8, 2016) is reaffirmed as trust land and the 1 actions of the Secretary of the Interior in taking that land 2 into trust are ratified and confirmed. 3 (b) APPLICATION.—Notwithstanding any other provi- 4 sion of law, an action (including an action pending in a 5 Federal court as of the date of enactment of this Act) re- 6 lating to the land described in subsection (a) shall not be 7 filed or maintained in a Federal court and shall be 8 promptly dismissed. 9 (c) APPLICABILITY OF LAWS.—All laws (including 10 regulations) of the United States of general applicability 11 to Indians or nations, Indian Tribes, or bands of Indians 12 (including the Act of June 18, 1934 (25 U.S.C. 5101 et 13 seq.)), shall be applicable to the Tribe and Tribal mem- 14 bers, except that to the extent such laws and regulations 15 are inconsistent with the terms of the Intergovernmental 16 Agreement, dated April 22, 2008, by and between the 17 Mashpee Wampanoag Tribe and the Town of Mashpee, 18 Massachusetts, the terms of that Intergovernmental 19 Agreement shall control. 20 Passed the House of Representatives May 15, 2019.
