Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. LAND EXCHANGE INVOLVING CAPE COD NA- 3 TIONAL SEASHORE. 4 (a) AUTHORIZATION OF EXCHANGE.—If title accept- 5 able to the Secretary of the Interior, acting through the 6 National Park Service (referred to hereafter in this section 7 as the ‘‘Secretary’’), for non-Federal land defined in sub- 8 section (b)(1) is conveyed to the United States, the Sec- 9 VerDate Sep 11 2014 23:11 Jan 18, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H313.IH H313 pamtmann on DSKBFK8HB2PROD with BILLS 2 •HR 313 IH retary shall convey to the owner of the non-Federal land, 1 subject to valid existing rights, all right, title, and interest 2 of the United States in and to the Federal land defined 3 in subsection (b)(2). 4 (b) LAND DESCRIPTIONS.— 5 (1) FEDERAL LAND.—The term ‘‘Federal land’’ 6 means the approximately 1.09 acres of land depicted 7 as Tract 22–4556 on the map titled ‘‘United States 8 Department of the Interior, National Park Service, 9 Northeast Region, Cape Cod National Seashore’’ 10 and dated October 20, 1963, Sheet 202–22A. 11 (2) NON-FEDERAL LAND.—The term ‘‘non-Fed- 12 eral land’’ means the approximately 1.02 acres of 13 land depicted as Tract 26–4653 on the map titled 14 ‘‘United States, Department of the Interior, Na- 15 tional Park Service, Northeast Region, Cape Cod 16 National Seashore’’ and dated October 27, 1964, 17 Sheet 202–26. 18 (c) ACCEPTABLE TITLE.—Title to the non-Federal 19 land conveyed to the United States under subsection (a) 20 shall be such title as is acceptable to the Secretary, in con- 21 formance with title approval standards applicable to Fed- 22 eral land acquisitions. 23 (d) APPLICABLE LAWS; TERMS AND CONDITIONS.— 24 The exchange under this section shall be subject to— 25 VerDate Sep 11 2014 23:11 Jan 18, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H313.IH H313 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 313 IH (1) the laws (including regulations) and policies 1 applicable to exchanges of land administered by the 2 National Park Service, including the laws and poli- 3 cies concerning equalization of values, and environ- 4 mental compliance; with the exception of appraisal 5 requirements; and 6 (2) such terms and conditions as the Secretary 7 determines to be appropriate. 8 (e) APPRAISALS.—For the purpose of valuation of the 9 land proposed for exchange under this section, the Sec- 10 retary may use the appraisals conducted by Michael Sut- 11 ton, Certified General Real Estate Appraiser, and dated 12 July 14 and July 22, 2009. 13 (f) ADMINISTRATION.—The land acquired by the Sec- 14 retary pursuant to the exchange authorized by this section 15 shall be administered as part of the Cape Cod National 16 Seashore. 17 (g) MAPS.—The maps referred to in subsection (a) 18 shall be on file and available for inspection in the appro- 19 priate offices of the Department of the Interior. 20 (h) DEFINITION OF IMPROVED PROPERTY.—Section 21 4(d) of Public Law 87–126 (16 U.S.C. 459b–3(d)) is 22 amended by adding at the end the following: ‘‘The term 23 ‘improved property’ includes such dwelling structures (in- 24 cluding the land thereon) as shall be conveyed by the Sec- 25 VerDate Sep 11 2014 23:11 Jan 18, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H313.IH H313 pamtmann on DSKBFK8HB2PROD with BILLS 4 •HR 313 IH retary pursuant to section 2 in exchange for conveyance 1 to or acquisition by the Secretary of an improved property 2 as described in this section.’’. 3 Æ VerDate Sep 11 2014 23:11 Jan 18, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H313.IH H313 pamtmann on DSKBFK8HB2PROD with BILLS
