A BILL
To maintain annual base funding for the Upper Colorado
and San Juan fish recovery programs through fiscal year
2023, to require a report on the implementation of those
programs, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Endangered Fish Re-
4
covery Programs Extension Act of 2019’’.

Section 3(d) of Public Law 106–392 (114 Stat. 1604;
5
126 Stat. 2444) is amended—
6
(1) by striking paragraph (1) and inserting the
7
following:
8
‘‘(1) AUTHORIZATION OF APPROPRIATIONS.—
9
‘‘(A) IN GENERAL.—There is authorized to
10
be appropriated to the Secretary to be used by
11
the Bureau of Reclamation to make the annual
12
base funding contributions to the Recovery Im-
13
plementation Programs $10,000,000 for each of
14
fiscal years 2020 through 2023.
15
‘‘(B)
NONREIMURSABLE
FUNDS.—The
16
funds contributed to the Recovery Implementa-
17
tion Programs under subparagraph (A) shall be
18
considered a nonreimbursable Federal expendi-
19
ture.’’; and
20
(2) in paragraph (2), by striking the fourth,
21
fifth, sixth, and seventh sentences.

SEC. 3. REPORT ON RECOVERY IMPLEMENTATION PRO-

GRAMS.

Section 3 of Public Law 106–392 (114 Stat. 1603;
3
126 Stat. 2444) is amended by adding at the end the fol-
4
lowing:
5
‘‘(j) REPORT.—
6
‘‘(1) IN GENERAL.—Not later than September
7
30, 2021, the Secretary shall submit to the appro-
8
priate committees of Congress a report that—
9
‘‘(A) describes the accomplishments of the
10
Recovery Implementation Programs;
11
‘‘(B) identifies—
12
‘‘(i) as of the date of the report, the
13
listing status under the Endangered Spe-
14
cies Act of 1973 (16 U.S.C. 1531 et seq.)
15
of the Colorado pikeminnow, humpback
16
chub, razorback sucker, and bonytail; and
17
‘‘(ii) as of September 30, 2023, the
18
projected listing status under that Act of
19
each of the species referred to in clause (i);
20
‘‘(C)(i) identifies—
21
‘‘(I) the total expenditures and the ex-
22
penditures by categories of activities by the
23
Recovery Implementation Programs during
24
the period beginning on the date on which
25
the applicable Recovery Implementation

Program was established and ending on

September 30, 2021; and
2
‘‘(II) projected expenditures by the
3
Recovery Implementation Programs during
4
the period beginning on October 1, 2021,
5
and ending on September 30, 2023; and
6
‘‘(ii) for purposes of the expenditures iden-
7
tified under clause (i), includes a description
8
of—
9
‘‘(I) any expenditures of appropriated
10
funds;
11
‘‘(II) any power revenues;
12
‘‘(III) any contributions by the States,
13
power customers, Tribes, water users, and
14
environmental organizations; and
15
‘‘(IV) any other sources of funds for
16
the Recovery Implementation Programs;
17
and
18
‘‘(D) describes—
19
‘‘(i) any activities to be carried out
20
under the Recovery Implementation Pro-
21
gram after September 30, 2023; and
22
‘‘(ii) the projected cost of the activi-
23
ties described under clause (i).

covery Implementation Programs in preparing the

report under paragraph (1).’’.
