Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Mill Springs Battle- 4 field National Monument Act’’. 5 SEC. 2. DEFINITIONS. 6 In this Act: 7 (1) MAP.—The term ‘‘Map’’ means the map en- 8 titled ‘‘Mill Springs Battlefield National Monument, 9 VerDate Sep 11 2014 04:26 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S32.IS S32 kjohnson on DSK79L0C42 with BILLS 2 •S 32 IS Nancy, Kentucky’’, numbered 297/145513, and 1 dated June 2018. 2 (2) MONUMENT.—The term ‘‘Monument’’ 3 means the Mill Springs Battlefield National Monu- 4 ment established by section 3(a)(1). 5 (3) SECRETARY.—The term ‘‘Secretary’’ means 6 the Secretary of the Interior, acting through the Di- 7 rector of the National Park Service. 8 SEC. 3. ESTABLISHMENT OF MILL SPRINGS BATTLEFIELD 9 NATIONAL MONUMENT. 10 (a) ESTABLISHMENT.— 11 (1) IN GENERAL.—Subject to paragraph (2), 12 there is established as a unit of the National Park 13 System, the Mill Springs Battlefield National Monu- 14 ment in the State of Kentucky, to preserve, protect, 15 and interpret for the benefit of present and future 16 generations— 17 (A) the nationally significant historic re- 18 sources of the Mill Springs Battlefield; and 19 (B) the role of the Mill Springs Battlefield 20 in the Civil War. 21 (2) DETERMINATION BY THE SECRETARY.— 22 The Monument shall not be established until the 23 date on which the Secretary determines that a suffi- 24 VerDate Sep 11 2014 04:26 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S32.IS S32 kjohnson on DSK79L0C42 with BILLS 3 •S 32 IS cient quantity of land or interests in land has been 1 acquired to constitute a manageable park unit. 2 (3) NOTICE.—Not later than 30 days after the 3 date on which the Secretary makes a determination 4 under paragraph (2), the Secretary shall publish in 5 the Federal Register notice of the establishment of 6 the Monument. 7 (4) BOUNDARY.—The boundary of the Monu- 8 ment shall be as generally depicted on the Map. 9 (5) AVAILABILITY OF MAP.—The Map shall be 10 on file and available for public inspection in the ap- 11 propriate offices of the National Park Service. 12 (6) ACQUISITION AUTHORITY.—The Secretary 13 may only acquire land or an interest in land located 14 within the boundary of the Monument by— 15 (A) donation; 16 (B) purchase from a willing seller with do- 17 nated or appropriated funds; or 18 (C) exchange. 19 (b) ADMINISTRATION.— 20 (1) IN GENERAL.—The Secretary shall admin- 21 ister the Monument in accordance with— 22 (A) this Act; and 23 (B) the laws generally applicable to units 24 of the National Park System, including— 25 VerDate Sep 11 2014 04:26 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S32.IS S32 kjohnson on DSK79L0C42 with BILLS 4 •S 32 IS (i) section 100101(a), chapter 1003, 1 and sections 100751(a), 100752, 100753, 2 and 102101 of title 54, United States 3 Code; and 4 (ii) chapter 3201 of title 54, United 5 States Code. 6 (2) MANAGEMENT PLAN.— 7 (A) IN GENERAL.—Not later than 3 years 8 after the date on which funds are first made 9 available to prepare a general management plan 10 for the Monument, the Secretary shall prepare 11 the general management plan in accordance 12 with section 100502 of title 54, United States 13 Code. 14 (B) SUBMISSION TO CONGRESS.—On com- 15 pletion of the general management plan, the 16 Secretary shall submit to the Committee on 17 Natural Resources of the House of Representa- 18 tives and the Committee on Energy and Nat- 19 ural Resources of the Senate the general man- 20 agement plan. 21 (c) PRIVATE PROPERTY PROTECTION.—Nothing in 22 this Act affects the land use rights of private property 23 owners within or adjacent to the Monument. 24 (d) NO BUFFER ZONES.— 25 VerDate Sep 11 2014 04:26 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S32.IS S32 kjohnson on DSK79L0C42 with BILLS 5 •S 32 IS (1) IN GENERAL.—Nothing in this Act, the es- 1 tablishment of the Monument, or the management of 2 the Monument creates a buffer zone outside the 3 Monument. 4 (2) ACTIVITY OR USE OUTSIDE MONUMENT.— 5 The fact that an activity or use can be seen, heard, 6 or detected from within the Monument shall not pre- 7 clude the conduct of the activity or use outside the 8 Monument. 9 Æ VerDate Sep 11 2014 04:26 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S32.IS S32 kjohnson on DSK79L0C42 with BILLS
