SHORT TITLE. 1 This Act may be cited as the ‘‘Enslaved Voyages Me- 2 morial Act’’. 3 SEC. 2. AUTHORIZATION TO ESTABLISH COMMEMORATIVE 4 WORK. 5 (a) IN GENERAL.—The Georgetown African Amer- 6 ican Historic Landmark Project and Tour may establish 7 a commemorative work on Federal land in the District of 8 Columbia and its environs to commemorate the enslaved 9 individuals, whose identities may be known or unknown, 10 who endured the Middle Passage. 11 (b) COMPLIANCE WITH STANDARDS FOR COMMEMO- 12 RATIVE WORKS.—The establishment of the commemora- 13 tive work under this section shall be in accordance with 14 chapter 89 of title 40, United States Code (commonly 15 known as the ‘‘Commemorative Works Act’’). 16 (c) PROHIBITION ON THE USE OF FEDERAL 17 FUNDS.— 18 (1) IN GENERAL.—Federal funds may not be 19 used to pay any expense of the establishment of the 20 commemorative work under this section. 21 (2) RESPONSIBILITY OF THE GEORGETOWN AF- 22 RICAN AMERICAN HISTORIC LANDMARK PROJECT 23 AND TOUR.—The Georgetown African American 24 Historic Landmark Project and Tour shall be solely 25 responsible for acceptance of contributions for, and 26 VerDate Sep 11 2014 00:54 Sep 22, 2022 Jkt 029200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4009.RFS H4009 pbinns on DSKJLVW7X2PROD with $$_JOB 3 HR 4009 RFS payment of the expenses of, the establishment of the 1 commemorative work under this section. 2 (d) DEPOSIT OF EXCESS FUNDS.— 3 (1) IN GENERAL.—If upon payment of all ex- 4 penses for the establishment of the memorial (in- 5 cluding the maintenance and preservation amount 6 required by section 8906(b)(1) of title 40, United 7 States Code), there remains a balance of funds re- 8 ceived for the establishment of the commemorative 9 work, the Georgetown African American Historic 10 Landmark Project and Tour shall transmit the 11 amount of the balance to the Secretary of the Inte- 12 rior for deposit in the account provided for in sec- 13 tion 8906(b)(3) of title 40, United States Code. 14 (2) ON EXPIRATION OF AUTHORITY.—If upon 15 expiration of the authority for the commemorative 16 work under section 8903(e) of title 40, United 17 States Code, there remains a balance of funds re- 18 ceived for the establishment of the commemorative 19 work, the Georgetown African American Historic 20 Landmark Project and Tour shall transmit the 21 amount of the balance to a separate account with 22 the National Park Foundation for memorials, to be 23 available to the Secretary of the Interior or Adminis- 24 trator (as appropriate) following the process pro- 25 VerDate Sep 11 2014 00:54 Sep 22, 2022 Jkt 029200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H4009.RFS H4009 pbinns on DSKJLVW7X2PROD with $$_JOB 4 HR 4009 RFS vided in section 8906(b)(4) of title 40, United States 1 Code, for accounts established under section 2 8906(b)(2) or (3) of title 40, United States Code. 3 SEC. 3. DETERMINATION OF BUDGETARY EFFECTS. 4 The budgetary effects of this Act, for the purpose of 5 complying with the Statutory Pay-As-You-Go Act of 2010, 6 shall be determined by reference to the latest statement 7 titled ‘‘Budgetary Effects of PAYGO Legislation’’ for this 8 Act, submitted for printing in the Congressional Record 9 by the Chairman of the House Budget Committee, pro- 10 vided that such statement has been submitted prior to the 11 vote on passage. 12 Passed the House of Representatives September 20, 2022.
