SHORT TITLE. 3 This Act may be cited as the ‘‘Darren Drake Act’’. 4 SEC. 2. BEST PRACTICES RELATED TO CERTAIN INFORMA- 5 TION COLLECTED BY RENTAL COMPANIES 6 AND DEALERS. 7 (a) DEVELOPMENT AND DISSEMINATION.— 8 (1) IN GENERAL.—Not later than one year 9 after the date of the enactment of this Act, the Sec- 10 retary of Homeland Security shall develop and dis- 11 seminate best practices for rental companies and 12 dealers to report suspicious behavior to law enforce- 13 ment agencies at the point of sale of a covered rental 14 vehicle. 15 (2) CONSULTATION; UPDATES.—The Secretary 16 shall develop and, as necessary, update the best 17 practices described in paragraph (1) after consulta- 18 tion with Federal, State, local, and Tribal law en- 19 forcement agencies and relevant transportation secu- 20 rity stakeholders. 21 (3) GUIDANCE ON SUSPICIOUS BEHAVIOR.—The 22 Secretary shall include, in the best practices devel- 23 oped under paragraph (1), guidance on defining and 24 VerDate Sep 11 2014 23:51 Oct 20, 2021 Jkt 029200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4089.RFS H4089 kjohnson on DSK79L0C42PROD with BILLS 3 HR 4089 RFS identifying suspicious behavior in a manner that pro- 1 tects civil rights and civil liberties. 2 (b) REPORT TO CONGRESS.—Not later than one year 3 after the date of the enactment of this Act, the Secretary 4 of Homeland Security shall submit to Congress a report 5 on the implementation of this section, including an assess- 6 ment of— 7 (1) the impact of the best practices described in 8 subsection (a) on efforts to protect the United 9 States against terrorist attacks; and 10 (2) ways to improve and expand cooperation 11 and engagement between— 12 (A) the Department of Homeland Security; 13 (B) Federal, State, local, and Tribal law 14 enforcement agencies; and 15 (C) rental companies, dealers, and other 16 relevant rental industry stakeholders. 17 (c) DEFINITIONS.—In this section: 18 (1) The terms ‘‘dealer’’ and ‘‘rental company’’ 19 have the meanings given those terms in section 20 30102 of title 49, United States Code. 21 (2) The term ‘‘covered rental vehicle’’ means a 22 motor vehicle that— 23 (A) is rented without a driver for an initial 24 term of less than 4 months; and 25 VerDate Sep 11 2014 23:51 Oct 20, 2021 Jkt 029200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H4089.RFS H4089 kjohnson on DSK79L0C42PROD with BILLS 4 HR 4089 RFS (B) is part of a motor vehicle fleet of 35 1 or more motor vehicles that are used for rental 2 purposes by a rental company. 3 Passed the House of Representatives October 19, 2021.
