To eliminate the disparity in sentencing for cocaine offenses,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Equal Enforcement
4
of Cocaine Laws Act’’.

SEC. 2. ELIMINATION OF INCREASED PENALTIES FOR CO-

CAINE OFFENSES WHERE THE COCAINE IN-

VOLVED IS COCAINE BASE.

(a)
CONTROLLED
SUBSTANCES
ACT.—Section
4
401(b)(1) of the Controlled Substances Act (21 U.S.C.
5
841(b)(1)) is amended—
6
(1) in subparagraph (A)—
7
(A) in clause (ii), in the matter preceding
8
subclause (I), by striking ‘‘5 kilograms’’ and in-
9
serting ‘‘280 grams’’;
10
(B) by striking clause (iii); and
11
(C) by redesignating clauses (iv) through
12
(viii) as clauses (iii) through (vii), respectively;
13
and
14
(2) in subparagraph (B)—
15
(A) in clause (ii), in the matter preceding
16
subclause (I), by striking ‘‘500 grams’’ and in-
17
serting ‘‘28 grams’’;
18
(B) by striking clause (iii); and
19
(C) by redesignating clauses (iv) through
20
(viii) as clauses (iii) through (vii), respectively.

ACT.—Section 1010(b) of the Controlled Substances Im-

port and Export Act (21 U.S.C. 960(b)) is amended—

of this Act, regardless of when the offense was committed.
