A BILL
To amend title 10, United States Code, to direct the Sec-
retary of Defense and the Secretaries of the military
department to monitor real property ownership and occu-
pancy in the vicinity of United States military installa-
tions inside and outside of the United States to identify
instances of ownership or occupancy by a foreign adver-
sary.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Military Perimeter
4
Transparency Act’’.

PROPERTY OWNERSHIP AND OCCUPANCY IN

VICINITY OF MILITARY INSTALLATIONS TO

IDENTIFY FOREIGN ADVERSARY OWNERSHIP
4
OR OCCUPANCY.

Section 2661 of title 10, United States Code, is
6
amended—
7
(1) by redesignating subsection (d) as sub-
8
section (e); and
9
(2) by inserting after subsection (c) the fol-
10
lowing new subsection (d):

‘‘(d) IDENTIFICATION
OF
FOREIGN
ADVERSARY
12
OWNERSHIP OR OCCUPANCY OF REAL PROPERTY IN VI-
13
CINITY OF MILITARY INSTALLATIONS.—(1) The Secretary
14
of Defense and each Secretary of a military department
15
shall monitor real property ownership and occupancy in
16
the vicinity of military installations under the jurisdiction
17
of the Secretary concerned inside and outside of the
18
United States to identify instances in which a foreign ad-
19
versary owns or occupies, or the Secretary concerned de-
20
termines a foreign adversary is seeking to own or occupy,
21
real property in the vicinity of a military installation.
22
‘‘(2) Not later than March 1 each year, the Secretary
23
of Defense, in coordination with the Secretaries of the
24
military departments, shall submit to the Committees on

Armed Services of the Senate and the House of Represent-

atives a report containing the following:
2
‘‘(A) A description of all real property in the vi-
3
cinity of military installations that the Secretary
4
concerned—
5
‘‘(i) has identified under paragraph (1) as
6
owned or occupied by a foreign adversary; or
7
‘‘(ii) has determined under paragraph (1)
8
that a foreign adversary is seeking to own or
9
occupy.
10
‘‘(B) Changes in foreign adversary ownership or
11
occupancy of real property in the vicinity of military
12
installations since the previous report.
13
‘‘(C) Recommendations regarding the appro-
14
priate response to such foreign adversary ownership
15
or occupancy of real property in the vicinity of mili-
16
tary installations.
17
‘‘(3) A report under paragraph (2) shall be submitted
18
in unclassified form, but may contain a classified annex
19
as necessary.

‘‘(4) In this section:
21
‘‘(A) The term ‘foreign adversary’ has the
22
meaning given that term in section 8(c)(2) of the
23
Secure and Trusted Communications Networks Act
24
of 2019 (47 U.S.C. 1607(c)(2)). The term includes

agents of, and partnerships and corporations includ-

ing, a foreign adversary.

‘‘(B) The term ‘military installation’ does not
3
include a contingency overseas military location de-
4
scribed in section 2687a(a)(3)(A)(iii) of this title.

‘‘(C) The term ‘vicinity’, with respect to prox-
6
imity to a military installation, means—
7
‘‘(i) real property adjacent to the boundary
8
of a military installation; and
9
‘‘(ii) real property any part of which is lo-
10
cated within 10 miles of the boundary of a mili-
11
tary installation.’’.
