Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Social Security Benefit 4 Payments Choice Act of 2021’’. 5 SEC. 2. PAYMENT DATE. 6 (a) IN GENERAL.—Section 205 of the Social Security 7 Act (42 U.S.C. 405) is amended by adding at the end the 8 following: 9 VerDate Sep 11 2014 00:52 Jul 02, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3914.IH H3914 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3914 IH ‘‘(v)(1) The Commissioner shall permit individuals 1 entitled to monthly insurance benefits under this title 2 (other than individuals concurrently entitled to benefits 3 under this title and title XVI) to select, at the time of 4 application for monthly insurance benefits or during the 5 annual, coordinated election period (as defined in section 6 1851(e)(3)(B)) for any calendar year, any day of the 7 month as the individual’s monthly payment date. 8 ‘‘(2) At the time an individual selects a monthly pay- 9 ment date as described in paragraph (1), the Commis- 10 sioner shall ensure that the individual is notified of the 11 effects of such selection, including any effects on the tim- 12 ing of delivery of benefit payments. 13 ‘‘(3) After an individual selects a monthly payment 14 date as described in paragraph (1), the Commissioner 15 shall send a notice to the individual that provides con- 16 firmation of the monthly payment date selected, the date 17 of the selection and the manner in which the selection was 18 made, and the 1st month for which the selection takes ef- 19 fect. 20 ‘‘(4) In any month in which the monthly payment 21 date selected by an individual as described in paragraph 22 (1) is a Saturday, Sunday, or Federal holiday, payment 23 shall be made— 24 VerDate Sep 11 2014 00:52 Jul 02, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3914.IH H3914 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3914 IH ‘‘(A) on the 1st day preceding such monthly 1 payment date that is not a Saturday, Sunday, or 2 Federal holiday in any case in which such preceding 3 day occurs during such month; and 4 ‘‘(B) in any other case, on the 1st day following 5 such monthly payment date that is not a Saturday, 6 Sunday, or Federal holiday.’’. 7 (b) EFFECTIVE DATE.—The amendments made by 8 this section shall take effect 1 year after the date of enact- 9 ment of this Act. 10 Æ VerDate Sep 11 2014 00:52 Jul 02, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3914.IH H3914 kjohnson on DSK79L0C42PROD with BILLS
