Ms. STABENOW (for herself, Mr. BLUNT, Mr. WYDEN, Mr. DAINES, Ms. COR-
TEZ MASTO, Ms. ERNST, Ms. SMITH, and Mr. TESTER) introduced the
following bill; which was read twice and referred to the Committee on Fi-
nance
A BILL
To expand the Medicaid certified community behavioral
health clinic demonstration program and to authorize
funding for additional grants to certified community be-
havioral health clinics.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Excellence in Mental
4
Health and Addiction Treatment Act of 2021’’.

SEC. 2. EXPANSION OF COMMUNITY MENTAL HEALTH

SERVICES DEMONSTRATION PROGRAM.
2
Section 223 of the Protecting Access to Medicare Act
3
of 2014 (42 U.S.C. 1396a note) is amended—
4
(1) in subsection (c), by adding at the end the
5
following new paragraph:
6
‘‘(3) PLANNING
GRANTS
FOR
ADDITIONAL
7
STATES.—In addition to the planning grants award-
8
ed under paragraph (1), the Secretary shall award
9
planning grants to States (other than States selected
10
to conduct demonstration programs under paragraph
11
(1) or (8) of subsection (d)) for the purpose of devel-
12
oping proposals to participate in time-limited dem-
13
onstration programs described in subsection (d).’’;
14
(2) in subsection (d)—
15
(A) in paragraph (3), by striking ‘‘Subject
16
to paragraph (8)’’ and inserting ‘‘Subject to
17
paragraphs (8) and (9)’’;
18
(B) in paragraph (5)(C)(iii)(II), by insert-
19
ing ‘‘or paragraph (9)’’ after ‘‘paragraph (8)’’;
20
(C) in paragraph (7)—
21
(i) in subparagraph (A), by inserting
22
‘‘through the year in which the last dem-
23
onstration under this section ends’’ after
24
‘‘annually thereafter’’;
25
(ii) in subparagraph (B)—

(I) by striking ‘‘December 31,
1
2021’’ and inserting ‘‘September 30,
2
2023’’; and
3
(II) by adding at the end the fol-
4
lowing new sentence: ‘‘Such rec-
5
ommendations shall include data col-
6
lected after 2019.’’; and
7
(iii) by adding at the end the fol-
8
lowing new subparagraph:
9
‘‘(C) FINAL EVALUATION.—Not later than
10
18 months after all demonstration programs
11
under this section have ended, the Secretary
12
shall submit to Congress a final evaluation of
13
such programs.’’; and
14
(D) by adding at the end the following new
15
paragraph:

‘‘(9) FURTHER
ADDITIONAL
PROGRAMS.—In
17
addition to the States selected under paragraphs (1)
18
and (8), the Secretary shall select any State that
19
submits an application that includes such informa-
20
tion as the Secretary shall require to conduct a dem-
21
onstration program that meets the requirements of
22
this subsection for 2 years or through September 30,
23
2023, whichever is longer.’’; and

(3) in subsection (f)(1)(B), by inserting ‘‘, and

$40,000,000 for fiscal year 2021’’ before the period.

SEC. 3. CERTIFIED COMMUNITY BEHAVIORAL HEALTH

CLINIC EXPANSION GRANTS.
4
Part D of title V of the Public Health Service Act
5
(42 U.S.C. 290dd et seq.) is amended by adding at the
6
end the following:
7
‘‘SEC. 553. CERTIFIED COMMUNITY BEHAVIORAL HEALTH
8
CLINIC EXPANSION GRANTS.
9
‘‘(a) IN GENERAL.—The Assistant Secretary shall
10
award grants to communities and community organiza-
11
tions that meet the criteria for certified community behav-
12
ioral health clinics under section 223(a) of the Protecting
13
Access to Medicare Act A of 2014. Grants awarded under
14
this subsection shall be for a period of not more than 5
15
years.
16
‘‘(b) TECHNICAL ASSISTANCE.—The Assistant Sec-
17
retary may provide appropriate information, training, and
18
technical assistance through appropriate contract proce-
19
dures to entities receiving grants under subsection (a), or
20
to health or social service providers pursuing certified
21
community behavioral health clinics status or partnering
22
with certified community behavioral health clinics, State
23
policymakers considering certified community behavioral
24
health clinics implementation under the Medicaid pro-

gram, and other stakeholders to facilitate successful imple-

mentation of the certification model.

‘‘(c) AUTHORIZATION OF APPROPRIATIONS.—

‘‘(1)
GRANT
PROGRAM.—For
purposes
of
4
awarding grants under subsection (a), there is au-
5
thorized to be appropriated $500,000,000 for the pe-
6
riod of fiscal years 2022 through 2024.
7
‘‘(2) TECHNICAL
ASSISTANCE.—For purposes
8
of carrying out the technical assistance program
9
under subsection (b), there are authorized to be ap-
10
propriated $5,000,000 for each of fiscal years 2022
11
through 2026.’’.
