Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. IMPROVING DATA COLLECTION ON THE SEXUAL 1 ORIENTATION AND GENDER IDENTITY OF DE- 2 CEASED INDIVIDUALS THROUGH THE NA- 3 TIONAL VIOLENT DEATH REPORTING SYS- 4 TEM. 5 (a) COLLECTION OF SEXUAL ORIENTATION AND 6 GENDER IDENTITY DATA.— 7 (1) IN GENERAL.—Not later than 120 days 8 after the date of enactment of this Act, the Director 9 of the Centers for Disease Control and Prevention 10 shall take measures to improve the incidence of the 11 collection of information on the sexual orientation 12 and gender identity of deceased individuals through 13 the National Violent Death Reporting System or any 14 successor programs. 15 (2) CONFIDENTIALITY.—Any information col- 16 lected relating to the sexual orientation or gender 17 identity of a decedent shall be maintained in accord- 18 ance with the confidentiality and privacy standards 19 and policies for the protection of individuals applica- 20 ble to all other data collected for purposes of the 21 National Violent Death Reporting System. 22 (b) DEFINITIONS.—In this section: 23 (1) GENDER IDENTITY.—The term ‘‘gender 24 identity’’ means an individual’s sense of being male, 25 VerDate Sep 11 2014 17:27 Jun 29, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3834.IH H3834 lotter on DSK11XQN23PROD with BILLS 3 •HR 3834 IH female, transgender, or another gender, as distinct 1 from the individual’s sex assigned at birth. 2 (2) SEXUAL ORIENTATION.—The term ‘‘sexual 3 orientation’’ means how a person identifies in terms 4 of their emotional, romantic, or sexual attractions, 5 and includes identification as straight, heterosexual, 6 gay, lesbian, or bisexual, among other terms. 7 (c) AUTHORIZATION.—There is authorized to be ap- 8 propriated $25,000,000 for fiscal year 2022 to carry out 9 this section. 10 SEC. 3.
