Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. EXEMPTION FOR SLAUGHTER AND PREPARATION 1 OCCURRING AT CUSTOM SLAUGHTER FACILI- 2 TIES. 3 Section 23 of the Federal Meat Inspection Act (21 4 U.S.C. 623) is amended— 5 (1) by redesignating subsections (b), (c), and 6 (d) as subsections (c), (d), and (e), respectively; 7 (2) by inserting after subsection (a) the fol- 8 lowing: 9 ‘‘(b) EXEMPTION FOR SLAUGHTER AND PREPARA- 10 TION OCCURRING AT CUSTOM SLAUGHTER FACILITIES.— 11 ‘‘(1) DEFINITION OF STATE.—In this sub- 12 section, the term ‘State’ means any State or Terri- 13 tory. 14 ‘‘(2) EXEMPTION.—The provisions of this title 15 requiring inspection of the slaughter of animals and 16 the preparation of the carcasses, parts thereof, meat, 17 and meat food products at establishments con- 18 ducting those operations for commerce shall not 19 apply to the slaughtering by any person of animals 20 at a custom slaughter facility and the preparation at 21 that custom slaughter facility and transportation in 22 commerce of the carcasses, parts thereof, meat, and 23 meat food products of those animals if— 24 ‘‘(A) the slaughtering and preparation car- 25 ried out at the custom slaughter facility is car- 26 VerDate Sep 11 2014 04:57 Jun 18, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2001.IS S2001 kjohnson on DSK79L0C42PROD with BILLS 3 •S 2001 IS ried out in accordance with the law of the State 1 in which the custom slaughter facility is lo- 2 cated; and 3 ‘‘(B) the animals are slaughtered and the 4 carcasses, parts thereof, meat, and meat food 5 products of the animals are prepared exclusively 6 for distribution to— 7 ‘‘(i) household consumers within the 8 State in which the custom slaughter facil- 9 ity is located; or 10 ‘‘(ii) restaurants, hotels, boarding 11 houses, grocery stores, or other establish- 12 ments located in the State in which the 13 custom slaughter facility is located that— 14 ‘‘(I) are involved in the prepara- 15 tion of meals served directly to con- 16 sumers; or 17 ‘‘(II) offer meat and meat food 18 products for sale directly to con- 19 sumers in the State.’’; and 20 (3) in subsection (c) (as so redesignated), in the 21 second sentence, by striking ‘‘paragraph (b)’’ and in- 22 serting ‘‘subsection’’. 23 VerDate Sep 11 2014 04:57 Jun 18, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2001.IS S2001 kjohnson on DSK79L0C42PROD with BILLS 4 •S 2001 IS SEC. 3.
