A BILL
To provide that not less than 3 percent of the amounts
made available for certain Federal-aid highway programs
shall be expended through veteran owned small business
concerns, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Better Utilizing Infra-
4
structure for Lasting Development of Veterans Businesses
5
Act of 2021’’ or the ‘‘BUILD Veterans Businesses Act
6
of 2021’’.

NESSES.

(a) DEFINITIONS.—In this section, the following defi-
4
nitions apply:
5
(1) SMALL
BUSINESS
CONCERN.—The term
6
‘‘small business concern’’ has the meaning given the
7
term in section 3 of the Small Business Act (15
8
U.S.C. 632).
9
(2) VETERAN.—The term ‘‘veteran’’ has the
10
meaning given the term in section 101(2) of title 38,
11
United States Code.

(3) VETERAN OWNED SMALL BUSINESS CON-
13
CERN.—The term ‘‘veteran owned small business
14
concern’’ has the meaning given the term ‘‘small
15
business concern owned and controlled by veterans’’
16
in section 3(q) of the Small Business Act (15 U.S.C.
17
632 (q)).

(b) AMOUNTS FOR VETERAN OWNED SMALL BUSI-
19
NESS CONCERNS.—Except to the extent that the Sec-
20
retary of Transportation determines otherwise, not less
21
than 3 percent of the amounts made available for Federal-
22
aid highway and public transportation funds made avail-
23
able under chapter 1 of title 23, United States Code, and
24
chapter 53 of title 49, United States Code, shall be ex-
25
pended through veteran owned small business concerns.

(c) UNIFORM CRITERIA.—The Secretary shall estab-

lish minimum uniform criteria for use by State govern-
2
ments in certifying whether a concern qualifies as a vet-
3
eran owned small business concern for the purpose of this
4
section. Such criteria shall include a limit on the personal
5
net worth of the veterans who own and control the small
6
business concern.

(d) REPORTING.—The Secretary shall establish min-
8
imum requirements for use by State government in report-
9
ing to the Secretary—
10
(1) information concerning veteran owned small
11
business concern awards, commitments, and achieve-
12
ment; and
13
(2) such other information as the Secretary de-
14
termined to be appropriate for the proper moni-
15
toring of the veterans business enterprise program.
