TESTING, REMOVAL, AND REMEDIATION BY DE- 1 PARTMENT OF DEFENSE OF 2 PERFLUOROALKYL SUBSTANCES AND 3 POLYFLUOROALKYL SUBSTANCES. 4 (a) TESTING.—Not later than two years after the 5 date of the enactment of this Act, the Secretary of Defense 6 shall complete testing for PFAS at all military installa- 7 tions, formerly used defense sites, and State-owned facili- 8 ties of the National Guard in the United States. 9 (b) REMOVAL.—Not later than 60 days following the 10 detection of PFAS at a military installation, formerly used 11 defense site, or State-owned facility of the National Guard 12 in the United States, the Secretary shall take removal ac- 13 tions to ensure that all individuals served by a drinking 14 water source contaminated by PFAS from the installation, 15 site, or facility have access to drinking water that meets 16 the applicable standard under subsection (d), regardless 17 of whether the Secretary is the drinking water purveyor. 18 (c) REMEDIATION.—Not later than ten years after 19 the date of the enactment of this Act, the Secretary shall 20 complete all physical construction required for the remedi- 21 ation of PFAS at all military installations, formerly used 22 defense sites, and State-owned facilities of the National 23 Guard in the United States. 24 (d) STANDARDS FOR REMOVAL OR REMEDIAL AC- 25 TIONS WITH RESPECT TO PFAS CONTAMINATION.—In 26 VerDate Sep 11 2014 02:35 Jun 17, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1973.IS S1973 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1973 IS conducting removal or remedial actions under this section, 1 the Secretary of Defense shall ensure that such actions 2 result in a level that meets or exceeds the most stringent 3 of the following standards for PFAS in any environmental 4 media: 5 (1) An enforceable State standard, in effect in 6 that State, for drinking, surface, or ground water, or 7 soil. 8 (2) An enforceable Federal standard for drink- 9 ing, surface, or ground water, or soil. 10 (3) A health advisory under section 11 1412(b)(1)(F) of the Safe Drinking Water Act (42 12 U.S.C. 300g–1(b)(1)(F)). 13 (e) DEFINITIONS.—In this section: 14 (1) FORMERLY USED DEFENSE SITE.—The 15 term ‘‘formerly used defense site’’ means any site 16 formerly used by the Department of Defense or Na- 17 tional Guard eligible for environmental restoration 18 by the Secretary of Defense funded under the ‘‘En- 19 vironmental Restoration Account, Formerly Used 20 Defense Sites’’ account established under section 21 2703(a)(5) of title 10, United States Code. 22 (2) PERFLUOROALKYL SUBSTANCE.—The term 23 ‘‘perfluoroalkyl substance’’ means a man-made 24 VerDate Sep 11 2014 02:35 Jun 17, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1973.IS S1973 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1973 IS chemical of which all of the carbon atoms are fully 1 fluorinated carbon atoms. 2 (3) PFAS.—The term ‘‘PFAS’’ means a 3 perfluoroalkyl substance or a polyfluoroalkyl sub- 4 stance. 5 (4) POLYFLUOROALKYL SUBSTANCE.—The 6 term ‘‘polyfluoroalkyl substance’’ means a man-made 7 chemical containing a mix of fully fluorinated carbon 8 atoms, partially fluorinated carbon atoms, and 9 nonfluorinated carbon atoms. 10 (5) MILITARY INSTALLATION.—The term ‘‘mili- 11 tary installation’’ has the meaning given that term 12 in section 2801(c)(4) of title 10, United States 13 Code. 14 SEC. 3.
