SHORT TITLE. 1 This Act may be cited as the ‘‘Bear River National 2 Heritage Area Study Act’’. 3 SEC. 2. DEFINITIONS. 4 In this Act: 5 (1) HERITAGE AREA.—The term ‘‘Heritage 6 Area’’ means the Bear River National Heritage 7 Area. 8 (2) SECRETARY.—The term ‘‘Secretary’’ means 9 the Secretary of the Interior. 10 (3) STATES.—The term ‘‘States’’ means the 11 States of Utah and Idaho. 12 (4) STUDY AREA.—The term ‘‘study area’’ 13 means— 14 (A) areas in the States that are within the 15 main drainage area of the Bear River; 16 (B) all of Cache, Box Elder, and Rich 17 Counties in the State of Utah, and Bear Lake, 18 Caribou, Franklin, and Oneida Counties in the 19 State of Idaho; 20 (C) the following communities in Utah: 21 Bear River, Brigham City, Corinne, Deweyville, 22 Elwood, Fielding, Garland, Honeyville, Howell, 23 Mantua, Perry, Plymouth, Portage, Snowville, 24 Tremonton, Willard, Amalga, Clarkston, Cor- 25 nish, Hyde Park, Hyrum, Lewiston, Logan, 26 VerDate Sep 11 2014 00:08 Nov 04, 2021 Jkt 029200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3616.RFS H3616 pbinns on DSKJLVW7X2PROD with BILLS 3 HR 3616 RFS Mendon, Millville, Newton, Nibley, North 1 Logan, Paradise, Providence, Richmond, River 2 Heights, Smithfield, Trenton, Wellsville, Garden 3 City, Laketown, Randolph, and Woodruff; 4 (D) the following communities in Idaho: 5 Malad, Clifton, Dayton, Franklin, Preston, Ox- 6 ford, Weston, Bancroft, Soda Springs, Grace, 7 Bloomington, Paris, Georgetown, Montpelier, 8 and St. Charles; and 9 (E) any other areas in the States that— 10 (i) have heritage aspects that are 11 similar to the areas described in subpara- 12 graphs (A), (B), (C), or (D); and 13 (ii) are adjacent to, or in the vicinity 14 of, those areas. 15 SEC. 3. STUDY. 16 (a) IN GENERAL.—The Secretary, in consultation 17 with State and local organizations and governmental agen- 18 cies, Tribal governments, non-profit organizations, and 19 other appropriate entities, shall conduct a study to assess 20 the suitability and feasibility of designating the study area 21 as a National Heritage Area, to be known as the ‘‘Bear 22 River National Heritage Area’’. 23 VerDate Sep 11 2014 00:08 Nov 04, 2021 Jkt 029200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3616.RFS H3616 pbinns on DSKJLVW7X2PROD with BILLS 4 HR 3616 RFS (b) REQUIREMENTS.—The study shall include anal- 1 ysis, documentation, and determinations on whether the 2 study area— 3 (1) has an assemblage of natural, historic, and 4 cultural resources that— 5 (A) represent distinctive aspects of the 6 people and cultures of the United States; 7 (B) are worthy of recognition, conserva- 8 tion, interpretation, and continuing use; and 9 (C) would be best managed— 10 (i) through partnerships among public 11 and private entities; and 12 (ii) by linking diverse and sometimes 13 noncontiguous resources and active com- 14 munities; 15 (2) reflects traditions, customs, beliefs, and 16 folklife that are a valuable part of the story of the 17 United States; 18 (3) provides outstanding opportunities— 19 (A) to conserve natural, historic, cultural, 20 or scenic features; and 21 (B) for recreation and education; 22 (4) contains resources that— 23 (A) are important to any identified themes 24 of the study area; and 25 VerDate Sep 11 2014 00:08 Nov 04, 2021 Jkt 029200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3616.RFS H3616 pbinns on DSKJLVW7X2PROD with BILLS 5 HR 3616 RFS (B) retain a degree of integrity capable of 1 supporting interpretation; 2 (5) includes residents, business interests, non- 3 profit organizations, and State, local, and Tribal 4 governments, and other appropriate entities that— 5 (A) are involved in the planning of the 6 Heritage Area; 7 (B) have developed a conceptual financial 8 plan that outlines the roles of all participants in 9 the Heritage Area, including the Federal Gov- 10 ernment; and 11 (C) have demonstrated support for the des- 12 ignation of the Heritage Area; 13 (6) has a potential management entity to work 14 in partnership with the individuals and entities de- 15 scribed in paragraph (5) to develop the Heritage 16 Area while encouraging State and local economic ac- 17 tivity; 18 (7) could impact the rights of private property 19 owners with respect to their private property; and 20 (8) has a conceptual boundary map that is sup- 21 ported by the public. 22 SEC. 4.
