A BILL
To amend title 23, United States Code, to provide for certain
requirements for Federal funds allocated for State or
local uses, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Stop Swaps, Protect
4
Local Jobs Act’’.
5
SEC. 2. PROJECT APPROVAL AND OVERSIGHT.
6
Section 106(g) of title 23, United States Code, is
7
amended by adding at the end the following:

‘‘(A) IN GENERAL.—If a State allows a
1
subrecipient to exchange Federal funds allo-
2
cated to such subrecipient in accordance with
3
the requirements of this title for State or local
4
funds, the State must certify to the Secretary
5
that the State—
6
‘‘(i) has prevailing wage requirements
7
that are comparable to the requirements
8
under section 113; and
9
‘‘(ii) will ensure that the prevailing
10
wage requirements described in clause (i)
11
shall apply to covered projects.
12
‘‘(B) APPLICABILITY.—The requirements
13
of this paragraph shall apply only if the re-
14
quirements of section 113 would be applicable
15
to a covered project if such project was carried
16
out using Federal funds.

‘‘(C) COVERED
PROJECT
DEFINED.—In
18
this paragraph, the term ‘covered project’
19
means a project carried out with exchanged
20
State or local funds as described in subpara-
21
graph (A).’’.
