Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. TREATMENT OF FUNDS RECEIVED BY NATIONAL 1 GUARD BUREAU AS REIMBURSEMENT FROM 2 STATES. 3 Section 710 of title 32, United States Code, is 4 amended by adding at the end the following new sub- 5 section: 6 ‘‘(g) TREATMENT OF REIMBURSED FUNDS.—(1) Any 7 funds received by the National Guard Bureau from a 8 State, the Commonwealth of Puerto Rico, the District of 9 Columbia, Guam, or the Virgin Islands, as reimbursement 10 under this section for the use of military property, shall 11 be— 12 ‘‘(A) credited to— 13 ‘‘(i) the appropriation, fund, or account 14 used in incurring the obligation; or 15 ‘‘(ii) an appropriate appropriation, fund, or 16 account currently available for the purposes for 17 which the expenditures were made; and 18 ‘‘(B) treated as a reprogramming request, pur- 19 suant to which such funds may not be obligated or 20 disbursed until after the Chief of the National 21 Guard Bureau— 22 ‘‘(i) submits a written request (including a 23 budget for the use of such funds, disaggregated 24 by appropriation and subactivity group) to the 25 Subcommittees on Defense of the Committees 26 VerDate Sep 11 2014 05:42 Jun 24, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3627.IH H3627 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3627 IH on Appropriations of the Senate and House of 1 Representatives for authorization; and 2 ‘‘(ii) receives such authorization. 3 ‘‘(2) Not later than October 31 of each year, the 4 Chief of the National Guard Bureau shall submit to the 5 Subcommittees on Defense of the Committees on Appro- 6 priations of the Senate and House of Representatives an 7 annual accounting of the use of the funds described in 8 paragraph (1), disaggregated by appropriation and sub- 9 activity group, during the immediately preceding fiscal 10 year.’’. 11 Æ VerDate Sep 11 2014 05:42 Jun 24, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3627.IH H3627 kjohnson on DSK79L0C42PROD with BILLS
