A BILL
To require the Secretary of Health and Human Services
to monitor compliance with the requirements of the
American Rescue Plan relating to the uses of funds
for child care.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Child Care Funds Ac-
4
countability Act’’.

SEC. 2. MONITORING COMPLIANCE WITH THE REQUIRE-

MENTS OF THE AMERICAN RESCUE PLAN ACT
2
RELATING TO THE USES OF FUNDS FOR
3
CHILD CARE STABILIZATION GRANTS AND
4
THE CHILD CARE AND DEVELOPMENT BLOCK
5
GRANT PROGRAM.

Section 2201 of the American Rescue Plan Act of
7
2021 (Public Law 117–2; March 11, 2021) is amended
8
by adding at the end the following:
9
‘‘(d) MONITORING COMPLIANCE.—
10
‘‘(1) IN GENERAL.—The Secretary shall dedi-
11
cate such portion of the amounts made available by
12
subsection (b) for Federal administrative costs in
13
carrying out this section as the Secretary determines
14
necessary to monitor compliance with the require-
15
ments relating to all uses of funds made available
16
under section 2202 for stabilization grants and
17
under this section for the child care and develop-
18
ment block grant program to ensure the integrity of
19
the program, including—
20
‘‘(A) compliance with the requirements
21
under subsection (c) and under section 2202(f),
22
and
23
‘‘(B) to ensure that there is no duplication
24
with loans under the Paycheck Protection Pro-
25
gram received by child care providers.

‘‘(2) REPORT TO CONGRESS.—Not later than
1
January 1, 2026, the Secretary shall make publicly
2
available and provide to the Committee on Finance
3
and the Committee on Health, Education, Labor,
4
and Pensions of the Senate, and the Committee on
5
Education and Labor and the Committee on Ways
6
and Means of the House of Representatives a report
7
summarizing the findings of compliance reviews
8
under this section.’’.
