to provide for additional procedures for families with
children under the age of 6, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ββLead-Safe Housing

for Kids Act of 2021ββ.

Section 302(a) of the Lead-Based Paint Poisoning
3
Prevention Act (42 U.S.C. 4822(a)) is amendedβ

(1) by redesignating paragraph (4) as para-

graph (5); and

(2) by inserting after paragraph (3) the fol-

2021, the Secretary shall promulgate regu-

housing in which a family with a child

of less than 6 years of age will reside

or is expected to reside to conduct an
17
initial risk assessment for lead-based
18
paint hazardsβ
19
ββ(aa) in the case of covered
20
housing receiving tenant-based
21
rental assistance under section 8
22
of the United States Housing Act
23
of 1937 (42 U.S.C. 1437f), not
24
later than 15 days after the date

residents in the covered housing

ment, and provide notice in the

common areas of the covered

housing, that lead-based paint

hazards were identified and will

be controlled within the 30-day
21
period described in item (aa);

no extension of the 30-day period de-
2
scribed in subclause (III)(aa).

ββ(iii) EXCEPTIONS.βThe regulations
4
promulgated under clause (ii) shall provide
5
an exception to the requirement under sub-
6
clause (I) of such clause for covered hous-
7
ingβ
8
ββ(I) if the owner of the covered
9
housing submits to the Secretary doc-
10
umentationβ
11
ββ(aa) that the owner con-
12
ducted a risk assessment of the
13
covered housing for lead-based
14
paint hazards during the 12-
15
month period preceding the date
16
on which the family is expected
17
to reside in the covered housing;
18
and
19
ββ(bb) of any clearance ex-
20
aminations of lead-based paint
21
hazard control work resulting
22
from the risk assessment de-
23
scribed in item (aa);

have no lead-based paint hazards;

ββ(IV) in accordance with any

other standard or exception the Sec-
4
retary deems appropriate based on
5
health-based standards.

ββ(B) RELOCATION.βNot later than 180
7
days after the date of enactment of the Lead-
8
Safe Housing for Kids Act of 2021, the Sec-
9
retary shall promulgate regulations to provide
10
that a family with a child of less than 6 years
11
of age that occupies a dwelling unit in covered
12
housing in which lead-based paint hazards were
13
identified, but not controlled in accordance with
14
regulations
required
under
subparagraph
15
(A)(ii), may relocate on an emergency basis and
16
without placement on any waitlist, penalty (in-
17
cluding rent payments to be made for that
18
dwelling unit), or lapse in assistance toβ
19
ββ(i) a dwelling unit that was con-
20
structed in 1978 or later; or
21
ββ(ii) another dwelling unit in covered
22
housing that has no lead-based paint haz-
23
ards.ββ.

SEC. 3. AUTHORIZATION OF APPROPRIATIONS.

There is authorized to be appropriated to carry out

the amendments made by section 2 such sums as may be
3
necessary for each of fiscal years 2022 through 2026.
