other purposes.

Mrs. MURRAY introduced the following bill; which was read twice and referred
to the Committee on Agriculture, Nutrition, and Forestry
A BILL
To amend the Child Nutrition Act of 1966 to clarify the
availability and appropriateness of training for local food
service personnel, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Improving Training
4
for School Food Service Workers Act of 2021’’.

SEC. 2. TRAINING AND CERTIFICATION OF ALL LOCAL
1
FOOD SERVICE PERSONNEL.
2
Section 7(g)(2)(B) of the Child Nutrition Act of 1966
3
(42 U.S.C. 1776(g)(2)(B)) is amended by adding at the
4
end the following:
5
‘‘(iv)
AVAILABILITY
AND
APPRO-
6
PRIATENESS OF TRAINING.—
7
‘‘(I) IN
GENERAL.—A training
8
program carried out under this sub-
9
paragraph shall—
10
‘‘(aa) be scheduled during
11
regular, paid working hours;
12
‘‘(bb) be offered in-person, if
13
appropriate;
14
‘‘(cc) incorporate experien-
15
tial learning; and
16
‘‘(dd) be provided at no cost
17
to food service personnel.
18
‘‘(II) PROGRAM OUTSIDE WORK-
19
ING
HOURS.—In the event that a
20
training program carried out under
21
this subparagraph is scheduled out-
22
side of regular, paid working hours—
23
‘‘(aa) efforts shall be made
24
to inform food service personnel
25
of the necessity of the program

to be scheduled outside of reg-
1
ular, paid working hours;
2
‘‘(bb) food service personnel
3
shall be consulted to schedule the
4
program at a time that is mini-
5
mally disruptive to the personnel
6
participating in the training pro-
7
gram;
8
‘‘(cc) compensation shall be
9
provided to food service personnel
10
attending the program at the
11
regular rate of pay, including any
12
applicable overtime rate; and
13
‘‘(dd) food service personnel
14
shall not be penalized or in any
15
other
manner
discriminated
16
against for not being able to at-
17
tend the program.

‘‘(v)
RELATIONSHIP
TO
OTHER
19
LAWS.—Nothing in this subparagraph su-
20
persedes or otherwise modifies any Fed-
21
eral, State, or local law or legal obligation
22
governing the relationship between an em-
23
ployee and employer.’’.
