and for other purposes.

A BILL
To amend title 23, United States Code, to provide eligibility
for certain emergency maintenance projects under the
emergency relief program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Fixing Infrastructure
4
Damaged by Disasters Act’’.
5
SEC. 2. EMERGENCY RELIEF.
6
Section 125 of title 23, United States Code, is
7
amended—

(1) in subsection (a)(1), by inserting ‘‘blizzard,
1
ice storm, wildfire,’’ before ‘‘flood’’;
2
(2) in subsection (d), by inserting after para-
3
graph (3) the following:

‘‘(4)
EMERGENCY
MAINTENANCE.—Notwith-
5
standing any other provision of this section, on the
6
request of a Governor of a State and with the ap-
7
proval of the Secretary, the cost of an emergency
8
maintenance project that is necessary due to an
9
event described in subsection (a), including mainte-
10
nance that would be considered heavy or routine
11
maintenance, but for the event, shall be an eligible
12
expense under this section.’’; and
13
(3) in subsection (g)—
14
(A) by striking ‘‘The Secretary’’ and in-
15
serting the following:
16
‘‘(1) IN GENERAL.—Except as provided in para-
17
graph (2), the Secretary’’; and
18
(B) by adding at the end the following:
19
‘‘(2) WAIVER.—On the request of a Governor of
20
a State, the Secretary may increase the amount
21
under paragraph (1) to not more than 25 percent.’’.
