SHORT TITLE. 3 This Act may be cited as the ‘‘American Indian and 4 Alaska Native Child Abuse Prevention and Treatment 5 Act’’, the ‘‘AI/AN Child Abuse Prevention and Treatment 6 Act’’, or ‘‘AI/AN CAPTA’’. 7 SEC. 2. GOVERNMENT ACCOUNTABILITY OFFICE REPORT 8 ON CHILD ABUSE AND NEGLECT IN INDIAN 9 TRIBAL COMMUNITIES. 10 (a) IN GENERAL.—The Comptroller General of the 11 United States (referred to in this section as the ‘‘Comp- 12 troller General’’) shall conduct a study and issue a report 13 on child abuse and neglect in Indian Tribal communities 14 for the purpose of identifying vital information and mak- 15 ing recommendations to the appropriate congressional 16 committees concerning issues relating to child abuse and 17 neglect in such communities. 18 (b) CONSULTATION WITH INDIAN TRIBES.—In car- 19 rying out this section, the Comptroller General shall con- 20 sult with Indian Tribes from each of the 12 regions of 21 the Bureau of Indian Affairs. 22 (c) DUTIES.—Not later than 2 years after the date 23 of enactment of this Act, the Comptroller General shall 24 submit to the Committee on Health, Education, Labor, 25 VerDate Sep 11 2014 00:51 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1868.IS S1868 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1868 IS and Pensions and the Committee on Indian Affairs of the 1 Senate and the Committee on Education and Labor and 2 the Committee on Natural Resources of the House of Rep- 3 resentatives a report on— 4 (1) the number of Indian Tribes providing pri- 5 mary child abuse and neglect prevention activities; 6 (2) the number of Indian Tribes providing sec- 7 ondary child abuse and neglect prevention activities; 8 (3) promising practices of Indian Tribes with 9 respect to child abuse and neglect prevention that 10 are culturally-based or culturally-adapted; 11 (4) information and recommendations on how 12 such culturally-based or culturally-adapted child 13 abuse and neglect prevention activities could become 14 evidence-based; 15 (5) the number of Indian Tribes that have 16 accessed Federal child abuse and neglect prevention 17 programs; 18 (6) child abuse and neglect prevention activities 19 that Indian Tribes provide using State funds; 20 (7) child abuse and neglect prevention activities 21 that Indian Tribes provide using Tribal funds; 22 (8) Tribal access to State children’s trust fund 23 resources; 24 VerDate Sep 11 2014 00:51 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1868.IS S1868 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1868 IS (9) how the children’s trust fund model could 1 be used to support prevention efforts regarding child 2 abuse and neglect of American Indian and Alaska 3 Native children; 4 (10) Federal agency technical assistance efforts 5 to address child abuse and neglect prevention and 6 treatment of American Indian and Alaska Native 7 children; 8 (11) Federal agency cross-system collaboration 9 to address child abuse and neglect prevention and 10 treatment of American Indian and Alaska Native 11 children; 12 (12) Tribal access to child abuse and neglect 13 prevention research and demonstration grants under 14 the Child Abuse Prevention and Treatment Act (42 15 U.S.C. 5101 et seq.); 16 (13) an examination of Federal child abuse and 17 neglect data systems to identify what Tribal data is 18 being submitted and barriers to submitting data; 19 and 20 (14) an examination of Federal child abuse and 21 neglect data systems to identify recommendations on 22 improving the collection of data from Indian Tribes. 23 VerDate Sep 11 2014 00:51 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1868.IS S1868 kjohnson on DSK79L0C42PROD with BILLS 5 •S 1868 IS SEC. 3. OTHER AMENDMENTS. 1 (a) GEOGRAPHICAL DISTRIBUTION.—Section 108(b) 2 of the Child Abuse Prevention and Treatment Act (42 3 U.S.C. 5106d(b)) is amended by inserting ‘‘Indian Tribes, 4 and Tribal organizations,’’ after ‘‘the States,’’. 5 (b) ALLOCATION OF AMOUNTS.—Section 203 of the 6 Child Abuse Prevention and Treatment Act (42 U.S.C. 7 5116b) is amended— 8 (1) by striking ‘‘section 210’’ each place it ap- 9 pears and inserting ‘‘section 209’’; and 10 (2) in subsection (a)— 11 (A) by striking ‘‘The Secretary’’ and in- 12 serting the following: 13 ‘‘(1) IN GENERAL.—Subject to paragraph (2), 14 the Secretary’’; and 15 (B) by adding at the end the following: 16 ‘‘(2) ALLOTMENT FOR INCREASED APPROPRIA- 17 TION YEARS.—In any fiscal year for which the 18 amount appropriated under section 209 exceeds the 19 amount appropriated under such section for fiscal 20 year 2020 by more than $1,000,000, the Secretary 21 shall reserve— 22 ‘‘(A) 5 percent of the amount appropriated 23 for the applicable fiscal year to make allotments 24 to Indian Tribes and Tribal organizations; and 25 VerDate Sep 11 2014 00:51 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S1868.IS S1868 kjohnson on DSK79L0C42PROD with BILLS 6 •S 1868 IS ‘‘(B) 1 percent of the amount appropriated 1 for the applicable fiscal year to make allotments 2 to migrant programs.’’. 3 Æ VerDate Sep 11 2014 00:51 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\S1868.IS S1868 kjohnson on DSK79L0C42PROD with BILLS
