Mrs. GILLIBRAND (for herself, Mr. BOOKER, Mr. PADILLA, and Mr. SAND-
ERS) introduced the following bill; which was read twice and referred to
the Committee on Agriculture, Nutrition, and Forestry
A BILL
To prevent childhood exposure to chlorpyrifos through certain
school meal programs.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Safe School Meals for
4
Kids Act of 2021’’.
5
SEC. 2. PREVENTING CHILDHOOD DIETARY EXPOSURE TO
6
CHLORPYRIFOS.

(a) IN GENERAL.—Beginning with the 2021–2022
8
school year, the Secretary of Agriculture (referred to in
9
this section as the ‘‘Secretary’’) shall phase out all food

that has been treated with, or has levels in excess of the
1
threshold established by the Secretary under subsection
2
(b)(1) of, chlorpyrifos residue in food—
3
(1) in school meals provided under the Richard
4
B. Russell National School Lunch Act (42 U.S.C.
5
1751 et seq.);
6
(2) in school meals provided under the school
7
breakfast program established by section 4 of the
8
Child Nutrition Act of 1966 (42 U.S.C. 1773); and
9
(3) provided by the Department of Defense
10
Fresh Fruit and Vegetable Program.

(b) REQUIREMENTS.—In carrying out subsection (a),
12
the Secretary shall—
13
(1) establish a threshold for chlorpyrifos for the
14
food described in subsection (a) of not more than
15
.001 micrograms of chlorpyrifos per kilogram of
16
food, as the Secretary determines to be necessary;
17
(2) provide guidance, in consultation with State
18
and local educational agencies, to eliminate chlorpyr-
19
ifos from meals provided by schools, which may in-
20
clude guidance or criteria related to food procure-
21
ment or supply contract policies;
22
(3) periodically update the guidance described
23
in paragraph (2); and

(4) provide technical assistance to State and

local educational agencies to enforce the require-
2
ments of this section.

(c) REVIEW BY THE SECRETARY.—Not later than
4
January 1, 2021, and every 2 years thereafter until Janu-
5
ary 1, 2028, the Secretary shall conduct a review to evalu-
6
ate whether, based on reports provided by State and local
7
educational agencies, any of the food described in sub-
8
section (a) exceeds the threshold for chlorpyrifos estab-
9
lished by the Secretary under subsection (b)(1).
