A BILL
To amend the American Rescue Plan Act of 2021 to require
increased oversight with respect to restaurant revitaliza-
tion grants, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Restaurant Recovery
4
Fairness Act of 2021’’.
5
SEC. 2. SUPPORT FOR RESTAURANTS.
6
Section 5003 of the American Rescue Plan Act of
7
2021 (Public Law 117–2) is amended—

(1) in subsection (c)(2), by adding at the end
1
the following new subparagraph:

‘‘(C) PREVENTION OF WASTE, FRAUD, AND
3
ABUSE.—The Administrator shall impose re-
4
quirements on applicants for the purpose of re-
5
ducing waste, fraud, and abuse.’’; and
6
(2) by adding at the end the following new sub-
7
sections:

‘‘(d) OVERSIGHT AND AUDIT PLAN.—
9
‘‘(1) IN
GENERAL.—Not later than 45 days
10
after the date of enactment of this subsection, the
11
Administrator shall submit to the Committee on
12
Small Business and Entrepreneurship of the Senate
13
and the Committee on Small Business of the House
14
of Representatives an oversight and audit plan that
15
details the policies and procedures of the Adminis-
16
trator for conducting oversight and an appropriate
17
level of audits with respect to grants made under
18
this section, which shall include the metrics used to
19
determine which grants to audit.

‘‘(2) REPORTS.—Not later than 60 days after
21
the date of enactment of this subsection, and each
22
month thereafter until the date that is 1 year after
23
the date on which all amounts appropriated under
24
subsection (b)(2) have been expended, the Adminis-

trator shall submit to the Committee on Small Busi-
1
ness and Entrepreneurship of the Senate and the
2
Committee on Small Business of the House of Rep-
3
resentatives a report on the oversight and audit ac-
4
tivities carried out by the Administrator with respect
5
to grants made under this section, which shall in-
6
clude for the period covered by the report—
7
‘‘(A) the number of grants approved and
8
disbursed;
9
‘‘(B) the amount of grant funds received
10
by each recipient;
11
‘‘(C) the number of active investigations
12
and audits of grants being conducted;
13
‘‘(D) the number of completed investiga-
14
tions and audits of grants, including a descrip-
15
tion of any findings of fraud or other material
16
noncompliance; and
17
‘‘(E) any substantial changes made to the
18
oversight and audit plan submitted under para-
19
graph (1).

‘‘(3) IDENTIFIABLE OR PROPRIETARY INFORMA-
21
TION.—The Administrator shall ensure that each re-
22
port submitted pursuant to paragraph (2) is free
