Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. ACTIVE DUTY DEFERMENT PERIODS COUNTED TO- 1 WARD PUBLIC SERVICE LOAN FORGIVENESS. 2 Section 455(m) of the Higher Education Act of 1965 3 (20 U.S.C. 1087e(m)) is amended— 4 (1) by redesignating paragraphs (2) through 5 (4) as paragraphs (3) through (5), respectively; 6 (2) in paragraph (1), in the matter preceding 7 subparagraph (A), by striking ‘‘paragraph (2)’’ and 8 inserting ‘‘paragraph (3)’’; and 9 (3) by inserting after paragraph (1) the fol- 10 lowing: 11 ‘‘(2) ACTIVE DUTY DEFERMENT PERIODS.— 12 Notwithstanding any other provision of this sub- 13 section, the Secretary shall deem each month for 14 which a loan payment was in deferment under sub- 15 section (f)(2) of this section or for which a loan pay- 16 ment was in forbearance under section 17 685.205(a)(7) of title 34, Code of Federal Regula- 18 tions (or similar successor regulations), for a bor- 19 rower described in subsection (f)(2)(C) as if the bor- 20 rower of the loan had made a payment for the pur- 21 pose of public service loan forgiveness under this 22 subsection.’’. 23 Æ VerDate Sep 11 2014 19:48 Jul 08, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H3486.IH H3486 pamtmann on DSKBC07HB2PROD with BILLS
