Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SUPPLY CHAIN FLEXIBILITY MANUFACTURING 1 PILOT. 2 (a) IN GENERAL.—Section 319F–2(a)(3) of the Pub- 3 lic Health Service Act (42 U.S.C. 247d–6b(a)(3)) is 4 amended— 5 (1) in subparagraph (I), by striking ‘‘and’’; 6 (2) in subparagraph (J), by striking the period 7 at the end and inserting ‘‘; and’’; and 8 (3) by adding at the end the following new sub- 9 paragraph: 10 ‘‘(K) enhance medical supply chain elas- 11 ticity and establish and maintain domestic re- 12 serves of critical medical supplies (including 13 personal protective equipment, ancillary medical 14 supplies, and other applicable supplies required 15 for the administration of drugs, vaccines and 16 other biological products, and other medical de- 17 vices (including diagnostic tests)) by— 18 ‘‘(i) increasing emergency stock of 19 critical medical supplies; 20 ‘‘(ii) geographically diversifying do- 21 mestic production of such medical supplies, 22 as appropriate; 23 ‘‘(iii) entering into cooperative agree- 24 ments or partnerships with respect to man- 25 ufacturing lines, facilities, and equipment 26 VerDate Sep 11 2014 05:35 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3463.IH H3463 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3463 IH for the domestic production of such med- 1 ical supplies; and 2 ‘‘(iv) managing, either directly or 3 through cooperative agreements with man- 4 ufacturers and distributors, domestic re- 5 serves established under this subparagraph 6 by refreshing and replenishing stock of 7 such medical supplies.’’. 8 (b) REPORTING; SUNSET.—Section 319F–2(a) of the 9 Public Health Service Act (42 U.S.C. 247d–6b(a)) is 10 amended by adding at the end the following: 11 ‘‘(6) REPORTING.—Not later than September 12 30, 2022, the Secretary shall submit to the Com- 13 mittee on Energy and Commerce of the House of 14 Representatives and the Committee on Health, Edu- 15 cation, Labor and Pensions of the Senate a report 16 on the details of each cooperative agreement or part- 17 nership entered into under paragraph (3)(K), includ- 18 ing the amount expended by the Secretary on each 19 such cooperative agreement or partnership. 20 ‘‘(7) SUNSET.—The authority to enter into co- 21 operative agreements or partnerships pursuant to 22 paragraph (3)(K) shall cease to be effective on Sep- 23 tember 30, 2024.’’. 24 VerDate Sep 11 2014 05:35 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3463.IH H3463 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3463 IH (c) FUNDING.—Section 319F–2(f) of the Public 1 Health Service Act (42 U.S.C. 247d–6b(f)) is amended by 2 adding at the end the following: 3 ‘‘(3) SUPPLY CHAIN ELASTICITY.— 4 ‘‘(A) IN GENERAL.—For the purpose of 5 carrying out subsection (a)(3)(K), there is au- 6 thorized to be appropriated $500,000,000 for 7 each of fiscal years 2021 through 2024, to re- 8 main available until expended. 9 ‘‘(B) RELATION TO OTHER AMOUNTS.— 10 The amount authorized to be appropriated by 11 subparagraph (A) for the purpose of carrying 12 out subsection (a)(3)(K) is in addition to any 13 other amounts available for such purpose.’’. 14 Æ VerDate Sep 11 2014 05:35 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3463.IH H3463 kjohnson on DSK79L0C42PROD with BILLS
