Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Small Transit Commu- 4 nities Modernization Act’’. 5 SEC. 2. ELIGIBLE AREA. 6 Section 5336(i) of title 49, United States Code, is 7 amended— 8 VerDate Sep 11 2014 00:32 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3329.IH H3329 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3329 IH (1) in paragraph (1) by striking subparagraph 1 (A) and inserting the following: 2 ‘‘(A) ELIGIBLE AREA.— 3 ‘‘(i) IN GENERAL.—Except as pro- 4 vided in clause (ii), the term ‘eligible area’ 5 means an urbanized area with a population 6 of less than 200,000 that meets or exceeds 7 in one or more performance categories the 8 industry average for all urbanized areas 9 with a population of at least 200,000 but 10 not more than 999,999, as determined by 11 the Secretary in accordance with sub- 12 section (c)(2). 13 ‘‘(ii) EXCEPTION.—For any fiscal 14 year beginning after the date of enactment 15 of the Small Transit Communities Mod- 16 ernization Act through fiscal year 2030, 17 with respect to a transit agency that 18 served an urbanized area determined by 19 the 2010 census to have had a population 20 of less than 200,000, the term ‘eligible 21 area’ shall include an urbanized area 22 that— 23 ‘‘(I) was determined to be an ur- 24 banized area with a population of at 25 VerDate Sep 11 2014 00:32 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3329.IH H3329 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3329 IH least 200,000 but not more than 1 999,999, according to the most recent 2 decennial census; and 3 ‘‘(II) met or exceeded one or 4 more of the performance categories 5 described in subparagraph (B) in each 6 of the 3 years prior to the year in 7 which the apportionment is pro- 8 vided.’’; and 9 (2) by adding at the end the following: 10 ‘‘(3) CENSUS PHASE-OUT.—Before apportioning 11 funds under subsection (h)(3), for any urbanized 12 area that is no longer an eligible area due to a 13 change in population in the most recent decennial 14 census, the Secretary shall apportion to such urban- 15 ized area, for 3 fiscal years, an amount equal to half 16 of the funds apportioned to such urbanized area pur- 17 suant to this subsection for the previous fiscal 18 year.’’. 19 Æ VerDate Sep 11 2014 00:32 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3329.IH H3329 kjohnson on DSK79L0C42PROD with BILLS
