Country specified. Sec. 8005. Definitions. DIVISION A—EXTENSION OF 1 SURFACE TRANSPORTATION 2 PROGRAMS 3 SEC. 1001. EXTENSION OF FEDERAL SURFACE TRANSPOR- 4 TATION PROGRAMS. 5 (a) IN GENERAL.—Except as otherwise provided in 6 this Act, the requirements, authorities, conditions, eligi- 7 bilities, limitations, and other provisions authorized under 8 the covered laws, which would otherwise expire on or cease 9 to apply after September 30, 2021, are incorporated by 10 reference and shall continue in effect through September 11 30, 2026. 12 (b) AUTHORIZATION OF APPROPRIATIONS.— 13 (1) HIGHWAY TRUST FUND.— 14 (A) HIGHWAY ACCOUNT.—There is author- 15 ized to be appropriated from the Highway Ac- 16 count for appropriation with respect to the program 3 from such account under the covered laws for 4 fiscal year 2021. 5 (B) MASS TRANSIT ACCOUNT.—There is 6 authorized to be appropriated from the Mass 7 Transit Account for each of fiscal years 2022 8 through 2026, for each program with respect to 9 which amounts are authorized to be appro- 10 priated from such account for fiscal year 2021, 11 an amount equal to the amount authorized for 12 appropriation with respect to the program from 13 such account under the covered laws for fiscal 14 year 2021. 15 (2) GENERAL FUND.—There is authorized to be 16 appropriated for each of fiscal years 2022 through 17 2026, for each program with respect to which 18 amounts are authorized to be appropriated for fiscal 19 year 2021 from an account other than the Highway 20 Account or the Mass Transit Account under the ti- 21 tles specified in subsection (e)(1)(A), an amount 22 equal to the amount authorized for appropriation 23 with respect to the program •HR 3341 IH (c) USE OF FUNDS.—Subject to section 1004(b), 1 amounts authorized to be appropriated for each of fiscal 2 years 2022 through 2026 with respect to a program under 3 subsection (b) shall be distributed, administered, limited, 4 and made available for obligation in the same manner as 5 amounts authorized to be appropriated with respect to the 6 program for fiscal year 2021 under the covered laws. 7 (d) OBLIGATION LIMITATION.—Subject to section 8 1004(d), a program for which amounts are authorized to 9 be appropriated under subsection (b)(1) shall be subject 10 to a limitation on obligations for each of fiscal years 2022 11 through 2026 in the same amount and in the same man- 12 ner as the limitation applicable with respect to the pro- 13 gram for fiscal year 2021. 14 (e) DEFINITIONS.—In this section, the following defi- 15 nitions apply: 16 (1) COVERED LAWS.—The term ‘‘covered laws’’ 17 means the following: 18 (A) Titles I, III, IV, V, and VI of division 19 A of the FAST Act (Public Law 114–94). 20 (B) Division A, division B, subtitle A of 21 title I and title II of division C, and division E 22 of MAP–21 (Public Law 112–141). 23 VerDate Sep 11 2014 22:49 Jun 29, 18 (J) Sections 116, 117, 330, and 5505 and 19 chapters 53, 303, 311, 313, 701, and 702 of 20 title 49, United States Code. 21 (2) HIGHWAY ACCOUNT.—The term ‘‘Highway 22 Account’’ means the portion of DSKJLVW7X2PROD with BILLS 8 •HR 3341 IH (3) MASS TRANSIT ACCOUNT.—The term ‘‘Mass 1 Transit Account’’ means the portion of the Highway 2 Trust Fund established under section 9503(e)(1) of 3 the Internal Revenue Code of 1986. 4 (f) DISADVANTAGED BUSINESS ENTERPRISES.— 5 (1) DEFINITIONS.—In this subsection, the fol- 6 lowing definitions apply: 7 (A) SMALL BUSINESS CONCERN.— 8 (i) IN GENERAL.—The term ‘‘small 9 business concern’’ means a small business 10 concern (as the term is used in section 3 11 of the Small Business Act (15 U.S.C. 12 632)). 13 (ii) EXCLUSIONS.—The term ‘‘small 14 business concern’’ does not include any 15 concern or group of concerns controlled by 16 the same socially and economically dis- 17 advantaged individual or individuals that 18 have average annual gross receipts during 19 the preceding 5 fiscal years in excess of 20 $26,290,000, as adjusted annually by the 21 Secretary for inflation. 22 (B) SOCIALLY AND ECONOMICALLY DIS- 23 ADVANTAGED on DSKJLVW7X2PROD with BILLS 9 •HR 3341 IH uals’’ has the meaning given the term in section 1 8(d) of the Small Business Act (15 U.S.C. 2 637(d)) and relevant subcontracting regulations 3 issued pursuant to such Act, except that women 4 shall be presumed to be socially and economi- 5 cally disadvantaged individuals for purposes of 6 this subsection. 7 (2) AMOUNTS FOR SMALL BUSINESS CON- 8 CERNS.—Except to the extent that the Secretary de- 9 termines otherwise, not less than 10 percent of the 10 amounts made available for any program under ti- 11 tles I, II, and III of this Act and section 403 of title 12 23, United States Code, shall be expended through 13 small business concerns owned and controlled by so- 14 cially and economically disadvantaged individuals. 15 (3) ANNUAL LISTING OF DISADVANTAGED BUSI- 16 NESS ENTERPRISES.—Each State shall annually— 17 (A) survey and compile a list of the small 18 business concerns referred to in paragraph (2) 19 in the State, including the location of the small 20 business concerns in the State, and publish 21 such list on a public website; and 22 (B) notify the Secretary, in writing, of the 23 percentage of the small •HR 3341 IH (i) women; 1 (ii) socially and economically dis- 2 advantaged individuals (other than 3 women); and 4 (iii) individuals who are women and 5 are otherwise socially and economically dis- 6 advantaged individuals. 7 (4) UNIFORM CERTIFICATION.— 8 (A) IN GENERAL.—The Secretary shall es- 9 tablish minimum uniform criteria for use by 10 State governments in certifying whether a con- 11 cern qualifies as a small business concern for 12 the purpose of this subsection. 13 (B) INCLUSIONS.—The minimum uniform 14 criteria established under subparagraph (A) 15 shall include, with respect to a potential small 16 business concern— 17 (i) on-site visits; 18 (ii) personal interviews with personnel; 19 (iii) issuance or inspection of licenses; 20 (iv) analyses of stock ownership; 21 (v)
