Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. OPERATION STONEGARDEN. 1 (a) IN GENERAL.—Subtitle A of title XX of the 2 Homeland Security Act of 2002 (6 U.S.C. 601 et seq.) 3 is amended by adding at the end the following: 4 ‘‘SEC. 2010. OPERATION STONEGARDEN. 5 ‘‘(a) ESTABLISHMENT.—There is established in the 6 Department a program, which shall be known as ‘Oper- 7 ation Stonegarden’, under which the Secretary, acting 8 through the Administrator, shall award grants to eligible 9 law enforcement agencies, through the State administra- 10 tive agency, to enhance border security in accordance with 11 this section. 12 ‘‘(b) ELIGIBLE RECIPIENTS.—A law enforcement 13 agency is eligible to receive a grant under this section if 14 the agency— 15 ‘‘(1) is located in— 16 ‘‘(A) a State bordering Canada or Mexico; 17 or 18 ‘‘(B) a State or territory with a maritime 19 border; and 20 ‘‘(2) is involved in an active, ongoing, U.S. Cus- 21 toms and Border Protection operation coordinated 22 through a U.S. Border Patrol sector office. 23 ‘‘(c) PERMITTED USES.—Grant funds received under 24 this section may be used for— 25 VerDate Sep 11 2014 03:30 Jun 03, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1709.IS S1709 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1709 IS ‘‘(1) equipment, including maintenance and 1 sustainment costs; 2 ‘‘(2) personnel, including overtime and backfill, 3 in support of enhanced border law enforcement ac- 4 tivities; 5 ‘‘(3) any activity permitted for Operation 6 Stonegarden under the Department of Homeland 7 Security’s most recent Homeland Security Grant 8 Program Notice of Funding Opportunity; and 9 ‘‘(4) any other appropriate activity, as deter- 10 mined by the Administrator, in consultation with the 11 Commissioner of U.S. Customs and Border Protec- 12 tion. 13 ‘‘(d) PERIOD OF PERFORMANCE.—The Secretary 14 shall award grants under this section to grant recipients 15 for a period of not less than 3 years. 16 ‘‘(e) REPORT.—For each of the fiscal years 2022 17 through 2026, the Administrator shall submit a report to 18 the Committee on Homeland Security and Governmental 19 Affairs of the Senate and the Committee on Homeland 20 Security of the House of Representatives containing infor- 21 mation on the expenditure of grants made under this sec- 22 tion by each grant recipient. 23 ‘‘(f) AUTHORIZATION OF APPROPRIATIONS.—There 24 is authorized to be appropriated $110,000,000 for each 25 VerDate Sep 11 2014 03:30 Jun 03, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1709.IS S1709 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1709 IS of the fiscal years 2022 through 2026 for grants under 1 this section.’’. 2 (b) CONFORMING AMENDMENT.—Section 2002(a) of 3 the Homeland Security Act of 2002 (6 U.S.C. 603(a)) is 4 amended to read as follows: 5 ‘‘(a) GRANTS AUTHORIZED.—The Secretary, through 6 the Administrator, may award grants under sections 2003, 7 2004, 2009, and 2010 to State, local, and tribal govern- 8 ments, as appropriate.’’. 9 (c) CLERICAL AMENDMENT.—The table of contents 10 in section 1(b) of the Homeland Security Act of 2002 is 11 amended by inserting after the item relating to section 12 2009 the following: 13 ‘‘Sec. 2010. Operation Stonegarden.’’. SEC. 3. REAUTHORIZATION OF THE HIGH INTENSITY DRUG 14 TRAFFICKING AREAS PROGRAM. 15 Section 707(p) of the Office of National Drug Con- 16 trol Policy Reauthorization Act of 1998 (21 U.S.C. 17 1706(p)) is amended to read as follows: 18 ‘‘(p) AUTHORIZATION OF APPROPRIATIONS.—There 19 is authorized to be appropriated to the Office of National 20 Drug Control Policy $300,000,000 for each of the fiscal 21 years 2022 through 2026 to carry out this section.’’. 22 VerDate Sep 11 2014 03:30 Jun 03, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1709.IS S1709 kjohnson on DSK79L0C42PROD with BILLS 5 •S 1709 IS SEC. 4.
