Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Lead Elimination and 4 Data Guidance Act’’ or the ‘‘LEAD Guidance Act’’. 5 SEC. 2. IDENTIFICATION OF HIGH-RISK LOCATIONS. 6 (a) DEVELOPMENT OF GUIDANCE.— 7 VerDate Sep 11 2014 04:38 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3255.IH H3255 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3255 IH (1) IN GENERAL.—In accordance with the dead- 1 line established in subsection (b), the Administrator 2 of the Environmental Protection Agency shall de- 3 velop guidance to help public water systems identify 4 high-risk locations for purposes of focusing efforts 5 to— 6 (A) test drinking water for the concentra- 7 tion of lead in such drinking water; and 8 (B) replace lead service lines. 9 (2) USE OF DATA.—The guidance developed 10 under paragraph (1) shall include information on 11 how a public water system may use data from the 12 American Community Survey conducted by the De- 13 partment of Commerce and, where available, 14 geospatial data to identify high-risk locations for the 15 purposes described in subsection (a). 16 (b) AVAILABILITY OF GUIDANCE.—Not later than 17 180 days after the date of enactment of this Act, the Ad- 18 ministrator of the Environmental Protection Agency 19 shall— 20 (1) publish the guidance developed under sub- 21 section (a) in the Federal Register; and 22 (2) make such guidance available on a publicly 23 accessible website. 24 VerDate Sep 11 2014 04:38 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3255.IH H3255 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3255 IH (c) REPORT.—Not later than 180 days after the date 1 of enactment of this Act, the Administrator of the Envi- 2 ronmental Protection Agency shall submit to the Com- 3 mittee on Energy and Commerce of the House of Rep- 4 resentatives and the appropriate committee of the Senate 5 a report that— 6 (1) includes the guidance developed under sub- 7 section (a); 8 (2) describes the methodology used to develop 9 such guidance; and 10 (3) provides information about who was con- 11 sulted in the development of such guidance. 12 (d) DEFINITIONS.—In this Act: 13 (1) HIGH-RISK LOCATION.—The term ‘‘high- 14 risk location’’ means an area— 15 (A) that is likely to have lead service lines; 16 and 17 (B) in which an environmental justice com- 18 munity is located. 19 (2) LEAD SERVICE LINE.—The term ‘‘lead serv- 20 ice line’’ has the meaning given such term in section 21 1459B(a) of the Safe Drinking Water Act (42 22 U.S.C. 300j–19b(a)). 23 (3) PUBLIC WATER SYSTEM.—The term ‘‘public 24 water system’’ has the meaning given such term in 25 VerDate Sep 11 2014 04:38 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3255.IH H3255 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3255 IH section 1401 of the Safe Drinking Water Act (42 1 U.S.C. 300f). 2 Æ VerDate Sep 11 2014 04:38 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3255.IH H3255 kjohnson on DSK79L0C42PROD with BILLS
