Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘National Secure Data 4 Service Act’’. 5 SEC. 2. NATIONAL SECURE DATA SERVICE. 6 (a) IN GENERAL.—The Director, in consultation with 7 the Chief Statistician of the United States, shall establish 8 a demonstration project to develop, refine and test models 9 to inform the full implementation of the Commission on 10 Evidence-Based Policymaking recommendation for a gov- 11 VerDate Sep 11 2014 00:37 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3133.IH H3133 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3133 IH ernment-wide data linkage and access infrastructure for 1 statistical activities conducted for statistical purposes, as 2 defined in chapter 35 of title 44, United States Code. 3 (b) ESTABLISHMENT.—Not later than one year after 4 the date of enactment of this Act, the Director shall estab- 5 lish a National Secure Data Service demonstration 6 project. The National Secure Data Service demonstration 7 project shall be— 8 (1) aligned with the principles, best practices, 9 and priority actions recommended by the Advisory 10 Committee on Data for Evidence Building, to the ex- 11 tent feasible; and 12 (2) operated directly by or via a contract that 13 is managed by the National Center for Science and 14 Engineering Statistics. 15 (c) DATA.—In carrying out this subsection, the Di- 16 rector shall engage with State and federal agencies to col- 17 lect, acquire, analyze, report, and disseminate statistical 18 data in the United States and other nations to support 19 governmentwide evidence-building activities consistent 20 with the Foundations for Evidence-Based Policymaking 21 Act of 2018. 22 (d) PRIVACY AND CONFIDENTIALITY PROTEC- 23 TIONS.—If the Director issues a management contract 24 under subsection (b), the awardee shall be designated as 25 VerDate Sep 11 2014 00:37 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3133.IH H3133 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3133 IH an ‘‘agent’’ under chapter 35 of title 44, United States 1 Code Subchapter III, section 3561 et seq., with all re- 2 quirements and obligations for protecting confidential in- 3 formation delineated in the Confidential Information Pro- 4 tection and Statistical Efficiency Act of 2018 and the Pri- 5 vacy Act of 1974. 6 (e) TECHNOLOGY.—In carrying out this subsection, 7 the Director shall consider application and use of systems 8 and technologies that incorporate protection measures to 9 reasonably ensure confidential data and statistical prod- 10 ucts are protected in accordance with obligations under 11 chapter 35 of title 44, United States Code, subchapter III, 12 section 3561 et seq., including systems and technologies 13 that ensure raw data and other sensitive inputs are not 14 accessible to recipients of statistical outputs from the Na- 15 tional Secure Data Service demonstration project. 16 (f) TRANSPARENCY.—The National Secure Data 17 Service established under subsection (b) shall maintain a 18 public website with up-to-date information on supported 19 projects. 20 (g) REPORT.—Not later than 2 years after the date 21 of enactment of this Act, the National Secure Data Serv- 22 ice demonstration project established under subsection (b) 23 shall submit a report to Congress that includes— 24 VerDate Sep 11 2014 00:37 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3133.IH H3133 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3133 IH (1) a description of policies for protecting data, 1 consistent with applicable Federal law; 2 (2) a comprehensive description of all completed 3 or active data linkage activities and projects; 4 (3) an assessment of the effectiveness of the 5 demonstration project for mitigating risks and re- 6 moving barriers to a sustained implementation of 7 the National Secure Data Service as recommended 8 by the Commission on Evidence-Based Policy- 9 making; and 10 (4) if deemed effective by the Director, a plan 11 for scaling up the demonstration project to facilitate 12 data access for evidence building while ensuring 13 transparency and privacy. 14 (h) AUTHORIZATION OF APPROPRIATIONS.—There 15 are authorized to be appropriated to the Director to carry 16 out this subsection $56,000,000 for each of fiscal years 17 2022 through 2026. 18 Æ VerDate Sep 11 2014 00:37 Jun 12, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3133.IH H3133 kjohnson on DSK79L0C42PROD with BILLS
