Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. STATE AND LOCAL LAW ENFORCEMENT ACCESS TO 1 LIFESAVING FEDERAL EQUIPMENT. 2 (a) UNENFORCEABILITY OF CERTAIN REGULATIONS 3 UNLESS ENACTED INTO LAW.— 4 (1) IN GENERAL.—No regulation, rule, guid- 5 ance, policy, or recommendations issued on or after 6 May 15, 2015, that limits the sale or donation of 7 property of the Federal Government, including ex- 8 cess property of the Department of Defense, to 9 State and local agencies for law enforcement activi- 10 ties (whether pursuant to section 2576a of title 10, 11 United States Code, or any other provision of law, 12 or as a condition on the use of Federal funds) shall 13 have any force or effect after the date of the enact- 14 ment of this Act unless enacted into law by Con- 15 gress. 16 (2) PROHIBITION ON USE OF FUNDS TO EN- 17 FORCE REGULATIONS.—No agency or instrumen- 18 tality of the Federal Government may use any Fed- 19 eral funds, fees, or resources to implement or carry 20 out a regulation, rule, guidance, policy, or rec- 21 ommendation issued as described in subsection (a) 22 that is not enacted into law by Congress. 23 (b) RETURN OR REISSUE OF EQUIPMENT RECALLED 24 OR SEIZED PURSUANT TO REGULATIONS.—Any property 25 recalled or seized on or after May 15, 2015, pursuant to 26 VerDate Sep 11 2014 00:38 May 27, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1597.IS S1597 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1597 IS a regulation, rule, guidance, policy, or recommendation 1 issued as described in subsection (a) shall be returned, re- 2 placed, or re-issued to the agency from which recalled or 3 seized, at no cost to such agency, as soon as practicable 4 after the date of the enactment of this Act. 5 Æ VerDate Sep 11 2014 00:38 May 27, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S1597.IS S1597 kjohnson on DSK79L0C42PROD with BILLS
