Mr. PETERS introduced the following bill; which was read twice and referred
to the Committee on Commerce, Science, and Transportation
A BILL
To require a review of the National Aeronautics and Space
Administration preference for domestic suppliers.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. REVIEW OF PREFERENCE FOR DOMESTIC SUP-
3
PLIERS.

(a) SENSE OF CONGRESS.—It is the Sense of Con-
5
gress that the National Aeronautics and Space Adminis-
6
tration (referred to in this section as ‘‘NASA’’) should,
7
to the maximum extent practicable and with due consider-
8
ation of foreign policy goals and obligations under Federal
9
law—

(1) use domestic suppliers of goods and serv-
1
ices; and
2
(2) ensure compliance with the Federal acquisi-
3
tion regulations, including subcontract flow-down
4
provisions.

(b) REVIEW.—
6
(1) IN
GENERAL.—Not later than 180 days
7
after the date of the enactment of this Act, the Ad-
8
ministrator of NASA shall undertake a comprehen-
9
sive review of the domestic supplier preferences of
10
NASA and the obligations of NASA under the Fed-
11
eral acquisition regulations to ensure compliance,
12
particularly with respect to Federal acquisition regu-
13
lations provisions that apply to foreign-based sub-
14
contractors.

(2) ELEMENTS.—The review under paragraph
16
(1) shall include—
17
(A) an assessment as to whether NASA
18
has provided funding for infrastructure of a for-
19
eign-owned company or State-sponsored entity
20
in recent years; and
21
(B) a review of any impact such funding
22
has had on domestic service providers.
23
(c) REPORT.—The Administrator of NASA shall sub-
24
mit to the Committee on Commerce, Science, and Trans-
