Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Stop CO Poisoning 4 Exposures Act’’ or the ‘‘SCOPE Act’’. 5 SEC. 2. RULEMAKING TO INSTALL AUTOMATIC SHUTOFF 6 SYSTEMS IN MOTOR VEHICLES. 7 (a) DEFINITIONS.—In this section: 8 VerDate Sep 11 2014 00:31 May 27, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1551.IS S1551 kjohnson on DSK79L0C42PROD with BILLS 2 •S 1551 IS (1) KEY.—The term ‘‘key’’ has the meaning 1 given the term in section 571.114 of title 49, Code 2 of Federal Regulations (or successor regulations). 3 (2) MANUFACTURER.—The term ‘‘manufac- 4 turer’’ has the meaning given the term in section 5 30102(a) of title 49, United States Code. 6 (3) MOTOR VEHICLE.— 7 (A) IN GENERAL.—The term ‘‘motor vehi- 8 cle’’ has the meaning given the term in section 9 30102(a) of title 49, United States Code. 10 (B) EXCLUSIONS.—The term ‘‘motor vehi- 11 cle’’ does not include— 12 (i) a motorcycle or trailer (as those 13 terms are defined in section 571.3 of title 14 49, Code of Federal Regulations) (or suc- 15 cessor regulations); 16 (ii) any motor vehicle that is rated at 17 more than 10,000 pounds gross vehicular 18 weight; or 19 (iii) a battery electric vehicle. 20 (4) SECRETARY.—The term ‘‘Secretary’’ means 21 the Secretary of Transportation. 22 (b) AUTOMATIC SHUTOFF SYSTEMS FOR MOTOR VE- 23 HICLES.— 24 (1) FINAL RULE.— 25 VerDate Sep 11 2014 00:31 May 27, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1551.IS S1551 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1551 IS (A) IN GENERAL.—Not later than 2 years 1 after the date of enactment of this Act, the Sec- 2 retary shall issue a final rule amending section 3 571.114 of title 49, Code of Federal Regula- 4 tions (relating to Federal Motor Vehicle Safety 5 Standard Number 114), to require manufactur- 6 ers to install in each motor vehicle equipped 7 with a keyless ignition device and an internal 8 combustion engine technology to automatically 9 shut off the motor vehicle after the motor vehi- 10 cle has idled for the period designated under 11 subparagraph (B). 12 (B) PERIOD DESCRIBED.— 13 (i) IN GENERAL.—The period referred 14 to in subparagraph (A) is the period des- 15 ignated by the Secretary as necessary to 16 prevent carbon monoxide poisoning. 17 (ii) DIFFERENT PERIODS.—The Sec- 18 retary may designate different periods 19 under clause (i) for different types of 20 motor vehicles, depending on the rate at 21 which the motor vehicle emits carbon mon- 22 oxide, if— 23 (I) the Secretary determines a 24 different period is necessary for a type 25 VerDate Sep 11 2014 00:31 May 27, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1551.IS S1551 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1551 IS of motor vehicle for purposes of sec- 1 tion 30111 of title 49, United States 2 Code; and 3 (II) requiring a different period 4 for a type of motor vehicle is con- 5 sistent with the prevention of carbon 6 monoxide poisoning. 7 (2) DEADLINE.—The rule under paragraph (1) 8 shall become effective on the date that is 1 year 9 after the date on which the Secretary issues that 10 rule. 11 Æ VerDate Sep 11 2014 00:31 May 27, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S1551.IS S1551 kjohnson on DSK79L0C42PROD with BILLS
