A BILL
To amend title XVIII of the Social Security Act to provide
a waiver of the cap on annual payments for nursing
and allied health education payments.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Technical Reset to Ad-
4
vance the Instruction of Nurses Act’’ or the ‘‘TRAIN
5
Act’’.

SEC. 2. WAIVER OF CAP ON ANNUAL PAYMENTS FOR NURS-
1
ING AND ALLIED HEALTH EDUCATION PAY-
2
MENTS.

(a) IN GENERAL.—Section 1886(l)(2)(B) of the So-
4
cial Security Act (42 U.S.C. 1395ww(l)(2)(B)) is amend-
5
ed—
6
(1) by striking ‘‘PAYMENTS.—Such ratio’’ and
7
inserting ‘‘PAYMENTS.—
8
‘‘(i) IN GENERAL.—Subject to clause
9
(ii), such ratio’’; and
10
(2) by adding at the end the following new
11
clause:
12
‘‘(ii) EXCEPTION TO ANNUAL LIMITA-
13
TION FOR EACH OF 2010 THROUGH 2019.—
14
For each of 2010 through 2019, the limi-
15
tation under clause (i) on the total amount
16
of additional payments for nursing and al-
17
lied health education to be distributed to
18
hospitals under this subsection for portions
19
of cost reporting periods occurring in the
20
year shall not apply to such payments
21
made in such year.’’.

(b) NO AFFECT ON PAYMENTS FOR DIRECT GRAD-
23
UATE MEDICAL EDUCATION.—Section 1886(h)(3)(D)(iii)
24
of
the
Social
Security
Act
(42
U.S.C.

1395ww(h)(3)(D)(iii)) is amended by adding at the end

the following sentence: ‘‘In applying the preceding sen-

tence for each of 2010 through 2019, the Secretary shall
2
not take into account any increase in the total amount
3
of such additional payment amounts for such nursing and
4
allied health education for portions of cost reporting peri-
5
ods occurring in the year pursuant to the application of
6
paragraph (2)(B)(ii) of such subsection.’’.
7
(c) RETROACTIVE APPLICATION.—The amendments
8
made by this section shall apply to payments made for
9
portions of cost reporting periods occurring in 2010 and
10
subsequent years.
