A BILL
To amend the Lobbying Disclosure Act of 1995 to prohibit
a former Member of Congress from making a lobbying
contact under such Act on behalf of a client which is
a Communist country, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘No Communist Coun-
4
tries Participating in Lobbying Act’’.

SEC. 2. PROHIBITING LOBBYING CONTACTS BY FORMER

MEMBERS OF CONGRESS ON BEHALF OF
2
COMMUNIST COUNTRIES.

(a) PROHIBITION.—The Lobbying Disclosure Act of
4
1995 (2 U.S.C. 1601 et seq.) is amended by inserting
5
after section 5 the following new section:
6
‘‘SEC. 5A. PROHIBITING LOBBYING CONTACTS BY FORMER
7
MEMBERS OF CONGRESS ON BEHALF OF
8
COMMUNIST COUNTRIES.
9
‘‘(a) PROHIBITION.—Notwithstanding any other pro-
10
vision of this Act, a former Member of Congress may not
11
make a lobbying contact under this Act, or any commu-
12
nication which would be a lobbying contact under this Act
13
if it were not disclosed under the Foreign Agents Registra-
14
tion Act of 1938, as amended (22 U.S.C. 611 et seq.),
15
on behalf of a client which, at the time of the lobbying
16
contact or communication, is a Communist country or an
17
entity owned or controlled by a Communist country.

‘‘(b) PENALTY.—In addition to any other penalty
19
under this Act, any person who violates subsection (a)
20
shall be subject to a fine of not more than $25,000 for
21
each such violation.

‘‘(c) DEFINITION.—In this section, a ‘Communist
23
country’ means a country which is treated as a Communist
24
country under section 620(f) of the Foreign Assistance
25
Act of 1961 (22 U.S.C. 2370(f)).’’.

(b) EFFECTIVE DATE.—The amendments made by

this section shall apply with respect to lobbying contacts
2
under the Lobbying Disclosure Act of 1995 which are
3
made on or after the date of the enactment of this Act.
