Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. Reg. 7619, relating to Tackling 3 the Climate Crisis at Home and Abroad) shall have no 4 force or effect. 5 (b) NO FEDERAL FUNDS.—No Federal funds may be 6 used to implement, administer, enforce, or carry out any 7 report or program substantially similar to the section re- 8 ferred to in subsection (a). 9 SEC. 3. NO-NET LOSS OF NON-FEDERAL LAND. 10 No Federal funds may be used to acquire non-Fed- 11 eral land within a State or county in which 15 percent 12 or more of the land is managed by a Federal agency, un- 13 less the Federal agency proposing the acquisition disposes 14 of an equal amount of Federal land within the impacted 15 State or county to ensure no net-loss of non-Federal land 16 and taxable acreage within the same fiscal year as the pro- 17 posed acquisition and thereafter. 18 SEC. 4. NO-NET LOSS OF MULTIPLE USE. 19 No Federal funds may be used to be used to imple- 20 ment, administer, enforce, or carry out any action on Fed- 21 eral land that results in a net-loss of multiple use or any 22 principle or major use within a State, unless such action 23 has been authorized by Federal statute. 24 VerDate Sep 11 2014 23:11 Jun 09, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3014.IH H3014 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 3014 IH SEC. 5. PROHIBITION ON WITHDRAWAL. 1 The President may not withdraw any Federal land 2 from forms of entry, appropriation, or disposal under pub- 3 lic land laws, location, entry, and patent under the mining 4 laws, or disposition under laws pertaining to mineral and 5 geothermal leasing or mineral materials unless the with- 6 drawal has been authorized by Federal statute. 7 SEC. 6. LIMITATIONS ON DECLARATIONS OF NATIONAL 8 MONUMENTS. 9 Section 320301 of title 54, United States Code, is 10 amended by adding at the end the following: 11 ‘‘(e) LIMITATIONS ON DECLARATIONS.—A declara- 12 tion under this section shall not apply to State or county 13 in which 15 percent or more of the land is managed by 14 a Federal agency.’’. 15 SEC. 7. DEFINITIONS. 16 In this section: 17 (1) FEDERAL LAND.— 18 (A) IN GENERAL.—The term ‘‘Federal 19 land’’ means— 20 (i) National Forest System land; 21 (ii) public lands (as defined in section 22 103 of the Federal Land Policy and Man- 23 agement Act of 1976 (43 U.S.C. 1702)); 24 (iii) the outer Continental Shelf (as 25 defined in section 2 of the Outer Conti- 26 VerDate Sep 11 2014 23:11 Jun 09, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3014.IH H3014 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 3014 IH nental Shelf Lands Act (43 U.S.C. 1331)); 1 and 2 (iv) Federal land with an Exclusive 3 Economic Zone (as defined in Proclama- 4 tion Numbered 5030, dated March 10, 5 1983)). 6 (B) CLARIFICATION.—The term ‘‘Federal 7 land’’ includes land described in clauses (i) 8 through (iv) of subparagraph (A) where the 9 rights to the surface estate or subsurface estate 10 is owned by a non-Federal entity. 11 (2) MULTIPLE USE.—The term ‘‘multiple use’’ 12 has the meaning given that term in section 103 of 13 the Federal Land Policy and Management Act of 14 1976 (43 U.S.C. 1702)). 15 (3) PRINCIPAL OR MAJOR USES.—The term 16 ‘‘principal or major uses’’ includes uses such as do- 17 mestic livestock grazing, mineral exploration and 18 production, rights-of-way, timber production, com- 19 mercial fishing, recreational fishing, hunting, camp- 20 ing, hiking, mountain biking, horseback riding, 21 whitewater rafting, and off-highway vehicle use, and 22 other outdoor recreation. 23 Æ VerDate Sep 11 2014 23:11 Jun 09, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3014.IH H3014 pamtmann on DSKBC07HB2PROD with BILLS
