Resilient Ports Act

Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Resilient Ports Act’’. 4 SEC. 2. PORT DEVELOPMENT. 5 Section 50302 of title 46, United States Code, is 6 amended— 7 (1) in subsection (c)— 8 (A) in paragraph (3)(A)(ii)— 9 VerDate Sep 11 2014 04:10 Jun 10, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3033.IH H3033 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3033 IH (i) in subclause (II) by striking ‘‘; or’’ 1 and inserting a semicolon; and 2 (ii) by adding at the end the fol- 3 lowing: 4 ‘‘(IV) emissions mitigation meas- 5 ures directly related to reducing the 6 overall carbon footprint from port op- 7 erations; or’’; 8 (B) in paragraph (6)(B)— 9 (i) in clause (i) by striking ‘‘; and’’ 10 and inserting a semicolon; 11 (ii) in clause (ii) by striking the pe- 12 riod and inserting ‘‘; and’’; and 13 (iii) by adding at the end the fol- 14 lowing: 15 ‘‘(iii) projects that increase the port’s 16 resilience to sea-level rise, flooding, and ex- 17 treme weather events, including such 18 events related to climate change.’’; 19 (C) in paragraph (7)(B) by striking ‘‘18 20 percent’’ and inserting ‘‘25 percent’’; and 21 (D) in paragraph (12) by adding at the 22 end the following: 23 ‘‘(D) RESILIENCE.—The term ‘resilience’ 24 means the ability to anticipate, prepare for, 25 VerDate Sep 11 2014 04:10 Jun 10, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3033.IH H3033 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3033 IH adapt to, withstand, respond to, and recover 1 from operational disruptions and sustain critical 2 operations at ports, including disruptions 3 caused by natural or manmade hazards. 4 ‘‘(E) CARBON FOOTPRINT.—The term 5 ‘carbon footprint’ means the total carbon-based 6 pollutants, products, and any greenhouse gases 7 that are emitted into the atmosphere resulting 8 from the consumption of fossil fuels. 9 ‘‘(F) CLIMATE CHANGE.—The term ‘cli- 10 mate change’ means detectable changes in 1 or 11 more climate system components over multiple 12 decades, including— 13 ‘‘(i) changes in the average tempera- 14 ture of the atmosphere or ocean; 15 ‘‘(ii) changes in regional precipitation, 16 winds, and cloudiness; and 17 ‘‘(iii) changes in the severity or dura- 18 tion of extreme weather, including 19 droughts, floods, and storms.’’; and 20 (2) in the heading for subsection (d) by striking 21 ‘‘INLAND’’ and inserting ‘‘INLAND RIVER’’. 22 Æ VerDate Sep 11 2014 04:10 Jun 10, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3033.IH H3033 kjohnson on DSK79L0C42PROD with BILLS
