A BILL
To modify the definition of a communist Chinese military
company for purposes of the imposition of certain sanc-
tions, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Holding Chinese Mili-
4
tary Companies Accountable Act’’.

THORITIES TO COMMUNIST CHINESE MILI-

TARY COMPANIES.

Section 1237(b)(4)(B) of the Strom Thurmond Na-
4
tional Defense Authorization Act for Fiscal Year 1999 (50
5
U.S.C. 1701 note) is amended—
6
(1) by striking clause (ii);
7
(2) in the matter preceding clause (i), by strik-
8
ing ‘‘that—’’ and inserting ‘‘that is engaged in pro-
9
viding commercial services, manufacturing, pro-
10
ducing, or exporting and—’’;
11
(3) in clause (i), by striking ‘‘; and’’ and insert-
12
ing ‘‘; or’’; and
13
(4) by adding at the end the following new
14
clause:
15
‘‘(ii)(I) is owned or controlled by, or
16
affiliated with, the Chinese Communist
17
Party or any person who has ever been a
18
delegate of a National People’s Congress of
19
the Chinese Communist Party; and
20
‘‘(II) is engaged in significant invest-
21
ment in the sectors of fifth-generation
22
wireless communications, artificial intel-
23
ligence, advanced computing, ‘big data’
24
analytics, autonomy, robotics, directed en-
25
ergy, hypersonics, or biotechnology.’’.

SEC. 3. EXTENSION OF AUTHORITY.

Notwithstanding section 1061(i)(6) of the National
2
Defense Authorization Act for Fiscal Year 2017 (10
3
U.S.C. 111 note), the submission required by subsection
4
(b) of section 1237 of the Strom Thurmond National De-
5
fense Authorization Act for Fiscal Year 1999—
6
(1) shall not terminate on December 31, 2021;
7
and
8
(2) shall continue in effect until December 31,
9
2026.
