Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Transform, Heal, and 4 Renew by Investing in a Vibrant Economy Act’’ or the 5 ‘‘THRIVE Act’’. 6 SEC. 2. PURPOSE; POLICY GOALS; AGENDA. 7 (a) PURPOSE.—The purpose of this Act is to mobilize 8 Federal efforts to respond, in a manner that is bold and 9 holistic, to the urgent concurrent crises of racial injustice, 10 the undermining of Tribal sovereignty, mass unemploy- 11 ment and economic inequality, the Coronavirus Disease 12 2019 pandemic, and climate change by establishing a na- 13 tional agenda to transform, heal, and renew the United 14 States to create a society that enables and supports— 15 (1) greater racial, Indigenous, gender, environ- 16 mental, and economic justice; 17 (2) dignified work opportunities; 18 (3) healthy communities; 19 (4) a stable climate; and 20 (5) healthy ecosystems. 21 (b) POLICY GOALS.—It is the policy of the United 22 States— 23 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2919 IH (1) to create and sustain millions of good, safe, 1 family-sustaining jobs with appropriate access to 2 labor organizations; 3 (2) to increase the power of workers to fight in- 4 equality in the workplace; 5 (3) to invest in historically underserved and im- 6 pacted communities, including Black, Tribal, Indige- 7 nous, Latinx, Arab, Asian, and Pacific Islander com- 8 munities, to increase the capacity of those commu- 9 nities to counteract racial, ethnic, gender, and other 10 social and economic injustices; 11 (4) to strengthen and heal the nation-to-nation 12 relationship between the United States and sov- 13 ereign Indian Tribes; 14 (5) to combat environmental injustice and en- 15 sure healthy lives for all people; 16 (6) to avert further climate and environmental 17 catastrophe; 18 (7) to ensure fairness for workers and commu- 19 nities affected by economic transitions; and 20 (8) to reinvest in public sector institutions that 21 enable workers and communities to thrive. 22 (c) AGENDA.— 23 (1) ESTABLISHMENT.—Not later than 120 days 24 after the date of enactment of this Act, the Presi- 25 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 2919 IH dent, in consultation with the Board, shall establish 1 a 10-year plan, to be known as the ‘‘Agenda to 2 Transform, Heal, and Renew by Investing in a Vi- 3 brant Economy’’, in accordance with which the pur- 4 pose and policy goals described in subsections (a) 5 and (b), respectively, shall be achieved. 6 (2) SUBMISSION.—The agenda established 7 under paragraph (1) shall be submitted to— 8 (A) the National Economic Council; and 9 (B) the Office of Management and Budget 10 for inclusion in each annual budget request sub- 11 mitted to Congress under section 1105 of title 12 31, United States Code, during the 10-year pe- 13 riod covered by the agenda. 14 SEC. 3. DEFINITIONS. 15 In this Act: 16 (1) ADMINISTERING AGENCY.—The term ‘‘ad- 17 ministering agency’’ means a Federal department or 18 agency with administrative jurisdiction over a quali- 19 fied investment program. 20 (2) BOARD.—The term ‘‘Board’’ means the 21 Transform, Heal, and Renew by Investing in a Vi- 22 brant Economy Recovery Board established under 23 section 4(a). 24 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 2919 IH (3) CARE WORKER.—The term ‘‘care worker’’ 1 means any individual who provides paid or unpaid 2 child care or dependent adult care, including— 3 (A) a domestic worker; 4 (B) a health care worker; 5 (C) a home health aide; and 6 (D) a nanny. 7 (4) ENVIRONMENTAL JUSTICE COMMUNITY.— 8 (A) IN GENERAL.—The term ‘‘environ- 9 mental justice community’’ means a low-income 10 or low-wealth community facing environmental 11 injustice. 12 (B) INCLUSIONS.—The term ‘‘environ- 13 mental justice community’’ includes any com- 14 munity that, as determined by the Board, in 15 consultation with the White House Environ- 16 mental Justice Advisory Council and the Na- 17 tional Environmental Justice Advisory Coun- 18 cil— 19 (i) is located nearest to an existing 20 area of grave environmental pollution and 21 degradation; 2 (II) a waste dump; or 3 (III) a facility for resource ex- 4 traction; 5 (iv) experiences a high incidence of 6 climate change impacts and extreme 7 weather disasters; 8 (v) has been excluded or harmed by 9 racist or discriminatory policies that have 10 resulted in economic or health disparities; 11 (vi) has a land-based or food subsist- 12 ence culture that is experiencing ecosystem 13 disruption and devastation; 14 (vii) faces relocation and resettlement 15 resulting from— 16 (I) climate change; 17 (II) impacts to the environment 18 and ecosystems; or 19 (III) impacts associated with eco- 20 nomic inequities; or 21 (viii) is an Indigenous community. 22 (5) EQUITY ASSESSMENT.—The term ‘‘equity 23 assessment’’, with respect to an investment, pro- 24 gram, plan, regulation, or operational decision, mean 25 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 7 •HR 2919 IH an assessment (which may include the assignment of 1 an equity score)— 2 (A) to evaluate the social, economic, and 3 environmental impacts of the investment, pro- 4 gram, plan, regulation, or decision on— 5 (i) impacted communities; and 6 (ii) environmental justice commu- 7 nities; and 8 (B) the goals of which are— 9 (i) to address historic inequality; 10 (ii) to ensure an equitable outcome; 11 (iii) to prevent further concentration 12 of pollution in areas experiencing an al- 13 ready high concentration of a pollutant or 14 other toxic substance; and 15 (iv) to minimize inadvertent dis- 16 proportionate social, economic, and envi- 17 ronmental effects of the investment, pro- 18 gram, plan, regulation, or decision. 19 (6) FAMILY-SUSTAINING JOB.—The term ‘‘fam- 20 ily-sustaining job’’ means an employment oppor- 21 tunity that provides an individual with a wage that 22 is sufficient to cover necessary expenses for the fam- 23 ily of the individual, such as food, medical care, 24 child care, housing, and transportation, without re- 25 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 8 •HR 2919 IH quiring reliance by the family on financial assistance 1 from any other source. 2 (7) FEDERAL SPENDING PROGRAM.—The term 3 ‘‘Federal spending program’’ means any program, 4 project, or other activity— 5 (A) carried out by, or pursuant to a con- 6 tract with, a Federal department or agency; 7 and 8 (B) for which Federal funds are made 9 available. 10 (8) HIGH-ROAD LABOR, EQUITY, OR ENVIRON- 11 MENTAL CONDITION.—The term ‘‘high-road labor, 12 equity, or environmental condition’’ means any con- 13 dition on the provision of Federal funding for a 14 qualified investment program, as established by the 15 President, based on advice of the Board, under sec- 16 tion 5(d)(3)(A). 17 (9) IMPACTED COMMUNITY.— 18 (A) IN GENERAL.—The term ‘‘impacted 19 community’’ means a community that is 20 harmed by environmental, economic, or socio- 21 economic injustice. 22 (B) INCLUSIONS.—The term ‘‘impacted 23 community’’ includes— 24 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 9 •HR 2919 IH (i) an environmental justice commu- 1 nity; and 2 (ii) a community that, as determined 3 by the Board, in consultation with the 4 White House Environmental Justice Advi- 5 sory Council and the National Environ- 6 mental Justice Advisory Council— 7 (I) has a high concentration of 8 low-income and low-wealth house- 9 holds, including households comprised 10 primarily of members of groups that 11 have historically experienced discrimi- 12 nation on the basis of race, gender, 13 national origin, or ethnicity (including 14 Black, Indigenous, Latinx, Arab, 15 Asian, and Pacific Islander commu- 16 nities); or 17 (II) faces economic transition, 18 deindustrialization, historic under- 19 investment, and poverty. 20 (10) IMPLEMENTING ENTITY.—The term ‘‘im- 21 plementing entity’’ means any public or private enti- 22 ty (including any Federal, Tribal, State, or local 23 agency and any firm, supplier, or subcontractor 24 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 10 •HR 2919 IH throughout the supply chain) that carries out a 1 qualified investment program using public support. 2 (11) INDIAN TRIBE.—The term ‘‘Indian Tribe’’ 3 means an Indian or Alaska Native tribe, band, na- 4 tion, pueblo, village, or community that the Sec- 5 retary of the Interior acknowledges to exist as an In- 6 dian Tribe pursuant to the Federally Recognized In- 7 dian Tribe List Act of 1994 (25 U.S.C. 5130 et 8 seq.). 9 (12) INDIGENOUS COMMUNITY.—The term ‘‘In- 10 digenous community’’ means— 11 (A) an Indian Tribe; 12 (B) a Native Hawaiian organization; 13 (C) a State-recognized Indian tribe; 14 (D) any reservation-based, urban Indige- 15 nous, or intertribal community, group, organi- 16 zation, or coalition; and 17 (E) an Alaska Native village. 18 (13) PUBLIC SUPPORT.— 19 (A) IN GENERAL.—The term ‘‘public sup- 20 port’’ means any financial or in-kind contribu- 21 tion provided by the President under section 5 22 for the administration, development, or imple- 23 mentation of a qualified investment program 24 carried out under this Act. 25 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 11 •HR 2919 IH (B) INCLUSIONS.—The term ‘‘public sup- 1 port’’ includes— 2 (i) technical support; 3 (ii) grants; 4 (iii) loans; 5 (iv) investments; and 6 (v) equity stakes. 7 (14) QUALIFIED INVESTMENT PROGRAM.—The 8 term ‘‘qualified investment program’’ means any 9 Federal spending program certified by the President 10 pursuant to section 5(c). 11 (15) STATE.—The term ‘‘State’’ means— 12 (A) a State; 13 (B) the District of Columbia; 14 (C) the Commonwealth of Puerto Rico; 15 and 16 (D) any other territory or possession of the 17 United States. 18 SEC. 4. THRIVE RECOVERY BOARD. 19 (a) ESTABLISHMENT.—Not later than 60 days after 20 the date of enactment of this Act, the President shall es- 21 tablish an advisory board, to be known as the ‘‘Transform, 22 Heal, and Renew by Investing in a Vibrant Economy Re- 23 covery Board’’, to advise the President and the heads of 24 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 12 •HR 2919 IH appropriate Federal departments and agencies regarding 1 the implementation of this Act. 2 (b) MEMBERSHIP.— 3 (1) COMPOSITION.—The Board shall be com- 4 posed of 20 members who, as determined by the 5 President— 6 (A) provide diverse and fair representation 7 from— 8 (i) impacted communities; 9 (ii) allies identified by impacted com- 10 munities; 11 (iii) Indigenous communities; and 12 (iv) labor organizations; and 13 (B) are qualified, through education, train- 14 ing, and experience, to evaluate information re- 15 lating to matters referred to the Board. 16 (2) APPOINTMENT.— 17 (A) IN GENERAL.—The members of the 18 Board shall be appointed by the President from 19 among individuals recommended by interested 20 individuals and entities. 21 (B) PROHIBITION.—A member of the 22 Board may not be an employee or former em- 23 ployee of the Federal Government. 24 (3) TERM; VACANCIES.— 25 VerDate Sep 11 2014 23:55 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6201 E:\BILLS\H2919.IH H2919 kjohnson on DSK79L0C42PROD with BILLS 13 •HR 2919 IH (A) TERM.—A member of the Board— 1 (i) shall be appointed to serve the 2 Board for an initial term of 3 years; and 3 (ii) may be reappointed to serve not 4 more than 1 additional term of not longer 5 than 3 years. 6 (B) VACANCIES.—A vacancy on the 7 Board— 8 (i) shall not affe [Text truncated for display.
